    HEARING OFFICER ORDER

On April 22, 2004, a telephonic status conference was held. Respondent did not appear
due to a conflict. In any event, the petitioner represented that the respondent is still reviewing its
proposal letter. If the proposal is accepted, the petitioner represented it will file a motion to
voluntarily dismiss this appeal. Petitioner requested that another telephonic status conference be
scheduled for 90 days. Petitioner’s request is granted.

The parties are directed to participate in a telephonic status conference with the hearing
officer on July 22, 2004, at 10:00 a.m. The telephone status conference will be initiated by the
petitioner, but each party is nonetheless responsible for its appearance. At the telephone status
conference, the parties must be prepared to discuss the status of the above-captioned matter and
    their readiness for hearing.

    IT IS SO ORDERED.
