    HEARING REPORT
     
    On April 23, 2004, a hearing in this matter was held at City Hall in West Frankfort,
    Franklin, County. Attorney Dale Guariglia appeared on behalf of the petitioner. Attorney
    Charles Matosian appeared on behalf of the Illinois Environmental Protection Agency.
     
    Witness Credibility
     
    Three witnesses testified during the hearing:
     
    Mr. James Claxton
    Mr. Dale Guariglia
    Mr. Andrew Polcyn
     
      
    Based upon my legal judgment, experience, and observations at hearing, I find that the
    credibility of witness is not an issue in this matter.

    Briefing Schedule
     
    The complete transcript is due May 5, 2004, and the public comment deadline is
