HEARING OFFICER ORDER
On April 22, 2004, a telephonic status conference was held. Respondent did not appear
due to a conflict. Petitioner represented that it is drafting a motion for clarification of the
December 18, 2003, Board order where it appears that the petitioner may be appealing the
August 6, 2003 high priority corrective action plan budget rejection (as addressed in the
December 18, 2004 Board order), and the September 8, 2003 partial rejection of the application
for payment from the underground storage tank fund.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on June 17, 2004, at 11:45 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
