pursuant to Section 4(r) ofthe Illinois
Environmental
Protection Act (“Act”), 415 ILCS

CDOE is thus a “delegated
unit”
and may issue administrative citations under

Respondent, ZEPEDA is an illinois resident who is the titled owner of
real
property having Property IdentificationNumbers of 26-07-105-006-0000 and
26-07-105-007-
0000, which are the southern two parcels ofreal property withan address of9613 South
Torrence
Avenue, Chicago, illinois.
3.
On February 26, 2004, CDOE inspector Lafayette Robertson inspected
Respondent’s property.
A copy ofhis inspection report is
attached as Exhibit
1 and made a
part
ofthis Administrative Citation.
4.
Based upon direct observations made by Mr. Robertson during the course ofhis
inspection, CDOE has determined that Respondent violated the Act as follows:

Respondent caused orallowedthe open dumping of waste in a manner
resulting in litter, in violation ofSection 2l(p)(l) ofthe Act,

(2004), Respondent is subject to a civil penalty ofOne Thousand Five Hundred

Affiant, Lafayette Robertson, being duly sworn, voluntarily deposes and states as follows:
1.
At all times relevantto the above-captioned Administrative Citation, Affiant was
employed as an inspector by the City ofChicago Department ofEnvironment.
2.
On February 26, 2004 between 1:30 p.m. and 3:00 p.m., Affiant conducted an
inspection ofthe southern portion ofthe property at 9613 South Torrence Avenue, Chicago,
illinois.
3.
Affiant conducted an onsite inspection, which included walking around the entire
property and photographing the site.
After the inspection, Affiant spoke with the property owner
Samuel Zepeda Sr. about his findings.
4.
In connectionwith this inspection and subsequent conversation, Affiant
completed the Inspection Report appendedto and made part ofthe above-captioned
Administrative Citation, which is an accurate record ofAffiant’s observations and factual
conclusions with respect to this site.

Upon my complete of the inspection at above site address, I met with
owner Samuel
Zepeda Sr 773-978-8050,
who stated to me the
collected waste debris consisting of broken concrete, rod iron, dirt,
stone, brick,
and wood, has been
on site for approximately two
years
due to his lack of business.
The owner stated that he was responsible
for the dumping of the above waste on the site.

observed.

The owner and I
returned to the areas
of concern in the yard area
and he
owner
stated to me he knew of the collections and storage of
waste debris on the site.
