pursuant to

ofthe Illinois Environmental Protection Act (“Act”), 415 ILCS 5/4(r)
(2004). CDOE is thus a
“delegated unit” and may issue administrative citations under 35

Respondent, ZEPEDA is
an IllinoisCorporationwho is the titled
owner ofreal
property having a Property Identification Number
of26-07-105-005-0000, which is the
northern
parcel ofreal property with an address of9613
South Torrenee
Avenue, Chicago, Illinois.
3.
On February 26, 2004, CDOE inspector Lafayette Robertson inspected
Respondent’s property.
A copy of his inspection report is attached as Exhibit
1
and
made a
part
ofthis Administrative Citation.

Based upon direct observations made by Mr. Robertson during the course ofhis
inspection,CDOE hasdetermined thatRespondent violated the Act as
follows:

Afliant, Lafayette Robertson, being duly sworn, voluntarily doposes and states as follows:

At all times relevant to the above-captioned Administrative Citation, Affiant was
employed as an inspector by the City ofChicago Departmentof Environment.
2.
On February 26, 2004 between 1:30 p.m. and 3:00 p.m., Affiant conducted an
inspection ofthe northern portion of the property at 9613
South Torrence Avenue, Chicago,
Illinois.
3.
Affiant conducted an onsite inspection, which included walking around the entire
property and photographing the site.
After the inspection, Afflant spoke with ZEPEDA’s
president, Samuel Zepeda about his findings.
4.
In connection with this inspection

subsequent conversation, Affiant

stone, brick, and wood, has been on site for approximately
two
years
due to
his
lack of business.
The owner stated that he was responsible
for the dumping of the above waste on the site.
