FACTS
1.
That Respondent, American
Disposal Services of Illinois, Inc., is the permitted owner
and operator of a facility located on the north and south side of Rowe Road at Route 23, Pontiac,
Livingston
County,
Illinois.
2.
That Respondent,
David
Bryant, is the Certified Operator of the above-referenced
facility.
3.
That
said
facility
is
operated
as
a
sanitary
landfill,
operating
under
Illinois
Environmental Protection Agency Permit No.
1995-337-LF, and is designated with Site Code No.
1058210002.
The facility is commonly known
to the Illinois
Environmental
Protection Agency as
Pontiac/Livingston Landfill.

That Respondents have owned and/or operated said facility at
all times
pertinent
hereto.
6.
That
on January 23, 2004, Kenneth Keigley of the Illinois Environmental Protection
Agency’s
Springfield
Regional
Office
inspected
the
above-referenced
facility.
A
copy of
his
inspection
report setting
forth the
results of said
inspection
is attached
hereto and
made a part
hereof.
VIOLATIONS
Based upon direct observations made by Kenneth Keigleyduring-Ihe course of his January
23. 2004
inspection of the above-referenced facility, the Illinois
Environmental Protection
Agency
has determined that Respondents violated the lllinois:Environmental Protection Act (hereinafter, the
‘Act”) as follows:
(1) That Respondents conducted a sanitary landfill operation
in a mannerwhich resulted in
the failure
to
collect and contain
litter from the site by the end
of the operating
day, a
violation of Section 21(o)(12) of theAct,
415 ILCS 5/21(o)(12) (2002).
CIVIL
PENALTY
Pursuant
to
Section
42(b)(4)
of the Act, 415
ILCS
5/42(b)(4)
(2002),
Respondents
are
subject
to
a
civil
penalty of
Five
Hundred
Dollars
($500.00) for
each
of the violations
identified
above, for atotal of Five Hundred Dollars ($500.00).
If Respondents elect not to petition the Illinois
Pollution Control
Board, the statutory civil penalty specified above shall be due and payable no later
than April
1, 2004, unless otherwise provided
by order of the Illinois Pollution Control
Board.
If Respondents elect to contestthis Administrative Citation by petitioning the Illinois Pollution
Control Board in accordance with Section 31.1
of the Act,415 ILCS 5/31.1(2002), and if the Illinois

Pollution Control Board issues a finding of violation as alleged herein, afteran adjudicatory hearing,
Respondents shall be assessed the associated hearingcosts-incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board.
Those hearing costs shall be assessed
in
addition
to
the statutory civil
penalty.
Pursuant to Section
31.1 (d)(1) of theAct, 415 ILCS 5/31.1 (d)(1) (2002),
if Respondents fail
to petition orelect not to petition the Illinois Pollution Control Board for reviewof this Administrative
Citation within thirty-five (35) days of the date of service, the Illinois

which shall include
this Administrative Citation

a finding
of violation
as
alleged
herein, and shall impose the statutory civil penaltyspecified above.

Affiant is a field inspector employed by the Land Pollution Control Divisionof the Illinois
Environmental Protection Agency and has been so employed at all
times pertinent
hereto.

23,
2004,
between

AM.
and
07:02
AM.,
Affiant
conducted
an
inspection of the sanitary
landfill
in
Livingston
County,
Illinois,
known
as
Livingston
Landfill,
Illinois Environmental Protection Agency Site No. 1058210002, operating under the permit numbers
1995-337-LF and
1999-307-LF.
3.
Affiant inspected said Livingston Landfill site by an on-site inspection, which included
walking the site.
4.
Before and/or
after
said inspection of said Livingston
Landfill
site,
Affiant reviewed
Illinois Environmental
Protection Agency permits issued
to the
subject site
and investigated
into
whether or not required documents were
timely filed
on behalf of the subject
site.
5.
As
a result of the activities
referred
to
in
Paragraph
3
above, Affiant completed the
Inspection Report
form
attached hereto and
made a
part hereof, which,
to the
best of Affiant’s
knowledge and belief, is an accuraterepresentation of Affiant’s observations and factual conclusions

A.M., I conducted an inspection
at the Livingston Landfill, located
on the north and
south side ofRowe Road
at Route 23,
in
Pontiac, Illinois.
This inspection was
conducted in response to
complaints from
local citizens
concerning blowing litter at the landfill.
The purpose ofthis inspection
was to
determine regulatory status and evaluate compliance with
the Environmental Protection
Act (Act) and
Title 35 Illinois Administrative Code, Subtitle
G:
Land Pollution (Regulations).
The inspection consisted ofwalking around the.site and taking
pictures, neither the Operations Manager or General Manager was present at the site and the
facility office was not
yet open.
The weather was Partly cloudy, the temperature

degrees.
Background:

Livingston Landfill is an
operating Putrescible/Chernical Waste Landfill operating under the
Illinois Environmental Protection Agency permit number 1995-337-LF for parcels A, B, and
C
and
1999-307 for Parcel D and regulated by
35
Illinois Administrative Code, Part 811,
Standards
for New Landfills.
The Landfill is owned by American Disposal Services ofIllinois, Inc.,
a
subsidiary ofAllied
Waste, whose Regional
Vice President, Kevin Finn,
is located at

This inspection addresses only the litter complaints and
litter issues
at the landfill.
No other
issues are addressed in
this
report.
When I arrived at the landfill I noted that no trucks had yet entered the landfill to
unload and the
wind was calm.
I waited until
daylight, parked
inside the landfill on the east side of cell D-6 then
traveled around the landfill looking for litter from the previous day’s operation.

I noted that dumping operations had commenced and litter was not
blowing from
the working
face ofthe landfill.
Inside the fenced
in portion of the landfill looking from the northeast corner of cell D-6 I looked
north and
saw litter in the form ofplastic and
paper scattered on the ground inside the fence (see
photos
#1
and #2).
In the perimeter ditch along the east side of cell D-6 the banks and bottom of theperimeter ditch
were lined with litter in the form ofpaper and
plastic (see photos #3, #4, #8, #9, #10, #11, and
#12).
I had been present in this area before the landfill opened and was certain that none ofthe
litter had blown there this operating day.
Driving toward the entrance to the landfill along the east side of cell D-6 I noticed litter in
the
form of plastic and paper scattered
on the east side of the access road between the access road
and the perimeter fence (see
photos
#5,
#6
and
#7).
I then drove around the facility and a short distance down the county roads surrounding the
landfill. I saw a small amount of litter along Rowe Road both on the north and south side near the
fence (see photos #13, #14,
and
#15).
I did not see
a
significant amount oflitter in the areas
along the various county roads surrounding the
landfill.
I left the site at 07:02
am.
Subsequent to the inspection, during the following week, I discussed the litter problem with Mr.
Bryant to let him know I had been to
the site and
let him know what I had observed.
He stated
that he was interested
in meeting with Agency Employees to discuss the problem and
remedy’s to
address the litter problem.
