HEARING OFFICER ORDER

On April 15, 2004, a telephonic status conference was held. Respondent did not appear.

Petitioner represented that it remains optimistic that the few issues that remain will be resolved

and that it anticipates that it will file a motion to voluntarily dismiss the above-captioned permit

appeal prior to the next status conference.

The parties or their legal representatives are directed to participate in a telephonic status

conference call with the hearing officer on June 17, 2004, at 9:00 a.m. The status conference

must be initiated by the petitioner, but each party is nonetheless responsible for its own

appearance. At the status conference, the parties must be prepared to discuss the status of the

above-captioned matter and their readiness for hearing.
