HEARING OFFICER ORDER
On April 8, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they intend to pursue settlement discussions in an
attempt to resolve or narrow the outstanding issues.
Respondent made an oral motion for an extension of time to file the record. Petitioner
had no objection. The respondent’s motion is granted to the extent that respondent must file the
record 14 days after issuance of notice of a public hearing, or at any earlier time ordered by the
hearing officer. Additionally, petitioner is free to request the hearing officer to order an earlier
filing of the record if it would expedite a resolution of this matter.
Petitioner represented that it will file a waiver of the statutory decision deadline.
The parties or their legal representatives are directed to participate in a telephonic status
conference with the hearing officer on June 10, 2004, at 10:30 a.m. The telephonic status
conference must be initiated by the petitioner, but each party is nonetheless responsible for its
own appearance. At the status conference, the parties must be prepared to discuss the status of
the above-captioned matter and their readiness for hearing.
