HEARING OFFICER ORDER
  
On April 1, 2004, all parties participated in a telephonic status conference with the
hearing officer. The parties represented that they are still discussing a supplemental
environmental project (SEP) as part of the settlement. The parties represented that a new or
revised SEP may have to be drafted and submitted to the Illinois Environmental Protection
Agency for review. The respondent made an oral motion for an extension of time to re-plead its
affirmative defense to
laches
as directed in the March 4, 2004 Board order. The complainant
had no objection. The respondent’s motion is granted. Respondent’s re-pleading is now due to
be filed on or before May 28, 2004.
 
The parties are directed to participate in a telephonic status conference with the hearing
officer on May 6, 2004, at 1:15 a.m. The status conference must be initiated by the complainant,
but each party is nonetheless responsible for their own appearance. At the status conference, the
parties must be prepared to discuss the status of the above-captioned matter and their readiness
for hearing.
IT IS SO ORDERED.
