Dear Chairman Novak:
Thank you very much for your February 17, 2004 letter requesting a determination as to whether
the Department of Commerce and Economic Opportunity (“Department”) intends to conduct an
economic impact study ofthe proposed rules in the above-referenced dockets.
The Department has reviewed the proposed amendments to certain regulations relatingto
Petroleum Leaking Underground Storage Tanks
(35
Iii. Adm. Code Parts 732 and 734). Based
on this review, and in light ofcontinued fiscal constraints, the Department has decided not to
conduct a study of the economic impact ofthe proposed amendments, pursuant to 415 ILCS
5/27(b).
