HEARING OFFICER ORDER
On March
15,
2004, the Board held the first hearing in this rulemaking.
A
second hearing
is scheduled to begin on Tuesday, May
25,
2004, at 9 a.m. at the McLean County Law
and
Justice Center, Room 700, Bloomington, Illinois.
All those who attend the hearing will be
required
to enter through security for the building.
Additional information about the McLean
County Law and Justice Center, including driving directions, can be obtained from the McLean
County website at www.mclean.gov/CircuitClerk. If necessary, the May
25,
2004hearing
will be
continued
on the record to
May 26,
2004,
at the Lincoln Library, 326
S.
Second Street,
Springfield,
Illinois
in Carnegie North on
the First Floor.
At the March
15,
2004
hearing, the hearing officer directed the filing ofprefiled questions
for the Illinois Environmental Protection Agency (Agency).
Any remaining questions for the
Agency should be pre-filed with the Board and served on all participants on the service list by
May 4, 2004.
In addition any person wishing to testify on May 25
or May 26 must prefile
testimony with the Board and serve
the testimony on all participants on the service list by
May 11, 2004.
The mailbox rule does not apply so that the questions or testimony must be
received in the Board’s Clerk’s office by the appropriate date.
Any questions may be addressed
to the hearing officer at the phone number and email address below.
The order ofthe second hearing will be:
1.
Agency answers to pre-filed questions and follow ups;
2.
Testimony by the persons who have prefiled testimony followed by questions of
the testifier.

The testimony ofpersons who have prefi led will be heard in
the order that the testimony is
received by the hearing officer, unless a special request
is made.
The testimony and questions
will be available either on the Board’s web page at www.ipcb.state.il.us or by contacting the
tiearing
officer.
