WHEREAS, on November 21,
1996 the County Board ofthe County ofSaline, Illinois,
granted local siting approval for a proposed expansion ofthe Saline County Landfill, and
WHEREAS, following that local
siting approval, Saline County Landfill, Inc.,
submitted to
the Illinois Environmental Protection Agency an application for a permit to expand that sanitary
landfill, in accordance with that local siting approval ofNovember 21, 1996; and
WHEREAS, on February 27, 2003, the County Board ofthe County of Saline adopted a
resolution that a letter be sent to the Enviromnental Protection Agency, requesting that State Agency
permit expansion ofthe Saline County Landfill as long as it met all environmental requirements; and
WHEREAS, the Saline County Board Chairman and the Chairman ofthe Landfill Committee
ofthe Saline County Board, forwarded a letter to the Environmental Protection Agency in support of
expanding the Saline County Landfill as long as all EPA requirements are met; and
WHEREAS, on or aboutDecember
5,
2003, the Illinois Environmental Protection Agency
denied a permit for expansion ofthe Saline
County Landfill, for reasons unrelated to environmental
safely, and the Saline County Landfill then appealed that decision to the Illinois Pollution Control
Board; and
WhEREAS, without prior permission or knowledge ofthe Saline
County Board, the Office
of the Saline County State’s Attorney, filed on January 27, 2004, a motion to intervene in that permit
appeal before the Illinois Pollution Control Board, to oppose expanding the Saline County Landfill.
NOW, it is herebyresolved as follows:
1.
The Motion ofthe State’s Attorney to intervene before the Illinois Pollution Control
Board, in cause PCB 04-117, is contrary to the position repeatedly stated by the County Board, the
County Board Chairman, and the Landfill Committee ofthe Saline County Board.

2.
The Saline County Board continues to support the proposed expansion ofthe Saline
County Landfill, so long as all environmental safety requirements are met.
3.
The Chairman ofthe Saline county Board is hereby authorized and requested to forward
correspondence to the Environmental Protection Agency and to the Clerk ofthe Pollution Control
Board,
with a copy ofthis resolution, confirming the State’s Attorney ofSaline County does not
represent the position ofthe Saline County Board, when he seeks to intervene in the permit appeal
ofthe Saline county Landfill, cause PCB 04-117.
