Bell
(“Respondent”)
is
the
present
owner of a facility
located
at
18781
Power Line
Road,
Grafton, Jersey County, Illinois.
The property is commonly known to the Illinois
Environmental Protection Agency as Otter Creek Twp./BeII.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and is designated with Site Code
No. 0838055001..
3.
That Respondent has owned and operated said facility at all times pertinenthereto.
4.
That
on
January
21, 2004,
Charlie
King
of the
Illinois
Environmental
Protection
Agency’s Marion
Regional
Office inspected the above-described facility.
A copy of his
inspection
report setting forth
the results of said
inspection is attached hereto
and
made a part hereof.
VIOLATIONS
Based upon direct observations made
by Charlie
King during the course of his January 21,
2004
inspection
of the above-named
facility, the
Illinois
Environmental
Protection
Agency
has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”) as follows:
(1)
That
Respondent
caused
or
allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of the Act,
415
ILCS
5/2l(p)(l)
(2002).
CIVIL PENALTY
Pursuant
to
Section
42(b)(4-5) of
the Act, 415
ILCS
5/42(b)(4-5)
(2002),
Respondent is
subject
to
a
civil
penalty of
One Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations
identified
above,
for
a
total of
One Thousand
Five
Hundred
Dollars
($1 ,500.00).
If
Respondent elects
not to
petition
the
Illinois
Pollution
Control
Board,
the statutory
civil penalty
specified above shall be due and payable no later than April
1,
2004, unless otherwise provided by
order of the Illinois
Pollution Control Board.
If Respondent elects to contest this Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1
of the Act, 415 ILCS 5/31.1
(2002), and if the Illinois
Pollution Control Board issues afinding of violation as alleged herein, after an adjudicatoryhearing,
Respondent shall be assessed the associated hearing costs incurred by the Illinois
Environmental
Protection Agency and the Illinois Pollution Control
Board.
Those hearing
costs shall be assessed
in addition
to the One Thousand
Five
Hundred
Dollar ($1 ,500.00) statutory civil penalty for each
violation.

Affiant is a field inspector employed by the Division of Land Pollution Control ofthe
Illinois Environmental Protection Agency and has been so employed at all times pertinent
hereto.

On January 21, 2004 between 9:00 AM and 10:00 AM,
Affiant conducted an
inspection of a disposal site operated without an Illinois Environmental Protection
Agency permit,
located in Jersey County, Illinois, and known as Otter Creek Twp./Bell
by the Illinois Environmental Protection Agency.
Said site has been assigned site code
number LPC# 0838055001 by the Illinois Environmental Protection Agency.

Affiant inspected
said Otter Creek Twp./Bell open dump site by an on-site inspection
which included walking and photographing the
site.
4.
As a result of the activities referred to in paragraph
3 above, Affiant completed the
Inspection Report form attached hereto and made a part hereof, which, to the best of
Affiant’s knowledge and belief, is
an accurate representation ofAffiant’s observations and
factual conclusions with respect to

The purpose of this memorandum is to
serve as the Narrative Inspection Report
Document of an inspection conducted at the subject site on January 21, 2004 from
approximately 9:00 a.m. until
10:00 a.m., by this
author.
Bruce Rodely, DWPC/FOS

Springfield Region, accompanied me on this inspection.
Mr. Rodely is the agricultural
inspector for the Springfield Regional Office.
The inspection was conducted to
investigate a complaint received at the Springfield Regional Office.
The complainant
alleged that white goods, tires and an old
vehicle were dumped in a ravine that a creek
runs through, near Grafton.
The complainant further stated that the owner had hogs on
the property and recently got rid ofthem.
The complainant was concerned with water
quality issues with the mixture ofopen dumping, tires and swine manure.
It was
determined that a multi-media inspection should be conducted, where Mr. Rodey
would
evaluate impact ofany agricultural waste and this
inspector would evaluate impact ofany
non-agricultural open dumped waste at the site.
As shown in this report, evidence of
open dumping and open burning was found at the site.
However, no agricultural wastes
were found.
Therefore,
a multi-media report will not be
generated.
The owner ofthe
property has received a Violation Notice (VN) for this site in the past under a separate
complaint (VN, L-1998-01399).
The site was subsequently cleaned up.
The site is located at the address of R. R. #
1, Box 72,

The legal and specific location was presented in this author’s Narrative
Inspection Report Document Memorandum to the Land Division File, dated October 8,
1998,
and therefore, will
not be repeated here.
The owner ofthe site is Roy Bell, R.
R.
#
1, Grafton, IL 62037.
His telephone number is:
618/786-3569. Although the Warranty
Deed for the site shows a Ruby Bell as a co-owner,
she told me in-person, during the site
inspection ofDecember
1,
1998, under the previous complaint, that she and Roy Bell
were divorced, that she had
signed a Quit Claim Deed, and that she was no
longer a
property owner ofthe
site. The tenants that live at the site are Tom and Dianna Joseph.
They have no
telephone.
Both the owner and the tenants are considered respondents.
Upon arrival at the site on January 21, 2004, the weatherwas cool
and partly cloudy.
The
air temperature was approximately
25°
F.
Winds were northwesterly at approximately 10
mph.
Surface soil conditions were mostly dry.
Photographs discussed herein were taken with a digital camera.
The photos show the
conditions at the site on the day ofthe inspection.
From the inspection and the
photographs,
a Site Sketch was developed.
It shows the general
layout ofthe site, as well
as the approximate locations and directions of the inspection photos.
The digital camera
assigns a three-digit number to each photograph, i.e., 001, 002, etc.
This is how the
photos are referred to
in this inspection report and on the Digital Photographs.
However,
to save space on the sketch, real numbers are used, i.e.,
1, 2,
etc.
Copies of the Digital
Photographs and the Site Sketch accompany this report.
Upon arrival at the site on January 21, 2004, Mr. Rodely and I went to
the doublewide
mobile home on-site and I knocked on the door.
A young man in his late teens or early
twenties answered the door.
I identified Mr. Rodely and myself and the purpose ofthe
visit.
Upon inquiry, he
stated that his name was Chris Joseph, and that he was the son of
tenants Tom and Dianna Joseph;
I gave him two business cards,
one for his parents and
one that I asked him to
have his parents give to Mr. Bell.
I asked him permission to
inspect the complaint and he granted us permission to do
so.
He further told us that he
was not aware of any livestock at the site.
It was obvious from the time of arrival that there was litter scattered about the site.
The
mobile home has a relatively flat area in front ofit where several cars could park.
Powerline Road borders the property to
the north.
Just beyond the parking area to the
east and south, there is an abrupt drop of a steep ravine slope that is approximately 40’ to
the bottom.
There is a gentle but
steady down slope behind the house that blends into a
wooded area.
It is not certain whetherthat part of the woods around the site is part ofthe
property or not.
Regardless, continuing into the woods

or so, there is another abrupt
drop ofapproximately 80’ into another ravine.
On the flat area in front
and to the south of the property, areas ofburned wastes were
observed.
We looked at these areas first.
Two small mounds ofburned waste,
measuring approximately 6’
x
5’
x
3’ high, were observed
first.
Small bits of plastics and
metals were observed in the piles.
Another relatively flat area ofburned waste was
observed next.
It measured approximately 6’ x 3’ x
1’ high.
These areas ofwaste are
shown in photo #s 001
and 003.
Note that estimated height measurements ofone
foot
(I
‘),
means any measurement up to
a foot in height.
Looking over the abrupt drop of
approximately 40’, more wastes could be seen on the ravine wall and at the bottom ofthe
ravine, as shown
in photo # 002.
Burned wastes, general household refuse, plastics and
wood were observed there.
Back on the flat surface in front ofthe mobile home, rolled
carpet, burned waste mounds measuring approximately 6’
x
5’
x
3’ and
3’
x
2’ x
1’, and
bags ofgeneral household refuse in an area measuring approximately
15’ x
5’
x
1’, were
observed, as shown in photo #
004.

Mr. Rodely and I then walked around
the truck shown in photo
#
004 and went down
what appeared to be the easiest access route to the bottom of the ravine,just east and
southeast ofthe flat area in front ofthe mobile home.
General household refuse,
some
burned, and
demolition wastes were observed on the steep ravine wall, as shown in photo
#s 005
and 006.
Walking in an arc back towards the south and southwest, plastics,
concrete slabs and
asphalt chunks were observed
in the ravine, as shown in photo #s 007
and
008.
Walking further along the bottom of the southern ravine, we encountered
roofing shingles
and more small various pieces oflitter along the sidewall of the ravine,
as shown in photo # 009.
We walked up
out of the southern ravine and
observed yet two more open dump and open
burn piles.
These measured approximately 6’ x 6’ x
1’ and 3’ x 3’ x
1’ respectively.
We
also observed approximately 50 waste tires on-site, approximately 40 ofthem just behind
the house.
These wastes can be
seen in photo #
010.
Together, these open burn piles had
plastics, cans, general household refuse, bedsprings, wood, boots, glass and clothing.
We walked into the edge ofthe wooded area and came close to
the steep 80’ ravine drop.
We observed a mattress as shown in photo #
011, a stove as shown in photo # 012, and in
the distance, off-site, a collection of rusted white
goods that were approximately 350’
away, as shown in photo # 013.
During the inspection, apparent violations ofthe Illinois Environmental Protection Act
(Act) and the regulations, Title 35, Illinois Administrative Code,
Subtitle G (35 IAC),
were observed.
Apparent violations ofthe Act include Sections:
9(a), 9(c),
2 1(a),
21(d)(l), 21(d)(2), 21(e), 2l(p)(l), 2l(p)(3),
21(p)(7)(i) and
55(a)(1).
An apparent
violation of the regulations, 35
JAC, was
Section:
812.101(a).
OTHER COMMENTS
1.
The complaint under Complaint #
C-99-006-C, that resulted in Violation Notice,
L-1998-0 1399 and L-1998-01400, was resolved via cleanup efforts that resulted
in
a re-inspection and delivery ofreceipts documenting cleanup, both on
December
1,
1998.
The new complaint, C-04-044-C involves renewed open
dumping and open burning with the same property owner, but new tenants.
2.
Although Chris Joseph was given two business cards to pass on to his parents,
Tom and Dianna Joseph, and to their landlord, Roy Bell, neither ofthese parties
have contacted this inspector as ofthe date of this memorandum.
