    ORDER OF THE BOARD (by T.E. Johnson):
     
      
    On September 2, 2003, complainant Lynn Erickson (Erickson) filed a complaint against
    respondent Charleston Classic Homes, Inc. and Lawrence E. Van Someren, Jr. (respondents).
    The Board accepted this case for hearing on November 6, 2003.
     
    On January 26, 2004, Erickson filed a motion to voluntarily dismiss this complaint. In
    the motion, Erickson asserted that the building from which emanated the source of the noise at
    issue in this case has been completed.
     
    To date, the respondents have not filed a response to the motion. Pursuant to Section
    101.500(d) of the Board’s procedural rules, if no response is filed to a motion within 14 days
    after service, the party will be deemed to have waived objection.

    101.500(d). Erickson’s motion to dismiss is granted, and the docket is closed.
     
    IT IS SO ORDERED.
