ORDER OF THE BOARD (by J.Theodore Meyer):
On March 2, 1998, complainant, People of the State of Illinois, filed a “Motion to
Voluntarily Dismiss Without Prejudice” (motion). In the motion, complainant asserts that on
June 30, 1997, the Chapter 11 bankruptcy case filed by respondents U.S. Dismantlement
Corporation and USDC Environmental, Inc. was ordered closed. Motion at 2. Complainant
further indicates that on February 2, 1998, respondents’ trustee in bankruptcy filed a “No
Asset Report.” Motion at 2. The Board notes that on January 8, 1998, we issued an interim
order finding respondents in default in response to complainant’s motion. However, in light of
respondents’ bankruptcy, complainant’s motion is granted and this matter is dismissed without
prejudice. Accordingly, this docket is closed.
    IT IS SO ORDERED.
I, Dorothy M. Gunn, Clerk of the Illinois Pollution Control Board, hereby certify that
the above order was adopted on the 5th day of March, 1998, by a vote of 6-0.
