HEARING OFFICER ORDER
On January 13, 2004,
the Illinois Environmental Protection Agency (Agency) filed a
proposal for rulemaking forPart 732 (R04-22) and Part 734 (R04-23).
The Agency proposes to
amend the Board’s petroleum leaking underground storage tanks rules.
On January 22, 2004, the
Board consolidated the two proposals for hearing and accepted this matter for hearing.
The Board will hold at least two hearings in this matter.
Both hearings will be conducted
to allow the Agency and all other interested parties the opportunity to present testimony on the
proposed rules.
The order ofthe first hearing will be:
1.
Opening statements;
2.
Testimony by the Agency; and
3.
Questions ofthe Agency.
The order ofthe second hearing will be determined at the beginning ofthe second hearing.
The “Notice List”
is the list ofinterested persons who wish to receive only the Board’s
opinions and orders and hearing officer orders in
this proceeding.
The “Service List” is persons
who wish to participate in the proceeding
and receive all prefiled testimony and to
be participants~
ofrecord.
To be placed on either the “Notice List” or the “Service List” contact the hearing
officer at the address Or phone number below.
Persons who plan to testif~’
must prefile their testimony.
The Agency shall prefile
testimony for the March 15, 2004 hearing by March 8, 2004.
That testimony will be available
either on the Board’s web page
at www.ipcb.state.il.us or by contacting the hearing officer.
The
prefiling deadline forthe second hearing will be established at the first hearing.
The second hearing will be held at the McLean County Law and Justice Center.
This
location
is the courthouse and related offices forMcLean County.
All those who attend the
hearing will be required to
enter through security for the building.
