FACTS
1.
That Herbert Lustand Francis Ann Lust (“Respondents”) are the present owners of a
facility
located
at 200
W. Franklin Street,
Bement, Piatt County,
Illinois.
Herbert Lust is also
the
present operator of the facility.
The
property
is commonly known
to
the
Illinois
Environmental
Protection Agency as Bement/Bement Plumbing
Supply Company.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating
Permit and is designated with
Site Code No.
1470055017.
3.
That Respondents have owned and operated said facilltyataIttimes-pert~nent
hereto.
4.
That
on
January
15,
2004,
Curt
White
of
the
Illinois
Environmental
Protection
Agency’s
Champaign
Regional
Office
inspected
the
above-described
facility.
A
copy
of
his
inspection
report setting
forth the
results
of said
inspection
is
attached
hereto
and
made a part
hereof.

VIOLATIONS
Based
upon direct observations
made by Curt White during the course of
his January 15,
2004
inspection
of the
above-named
facility, the
Illinois
Environmental
Protection
Agency
has
determined that Respondents have violated the Illinois Environmental Protection Act (hereinafter,
the “Acr’) as follows:
(1)
That
Respondent caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of
the Act,
415
ILCS 5/21(p)(1)
(2002).
(2)
That
Respondent
caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
open
burning,
a
violation
of
Section
21(p)(3)
of
the
Act,
415
ILCS
5/21 (p)(3) (2002).
CIVIL PENALTY
Pursuant to
Section 42(b)(4-5) of the Act, 415
ILCS 5/42(b)(4-5) (2002),
Respondentsare
subject
to
a
civil
penalty of One
Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations identified above, for a total of Three Thousand Dollars ($3,000.00).
If Respondents elect
not to petition the Illinois Pollution Control Board, the statutory civil penalty specified above shall be
due and
payable
no
later than
March
30, 2004,
unless
otherwise
provided by order of the Illinois
Pollution Control
Board.
If Respondents elect to contest this Administrative Citation by petitioningthe Illinois Pollution
Control Board
in accordance with Section 31.1 oftheAct, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues a finding of violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental

in
addition

INSPECTION REPORT
NARRATIVE

Champaign Regional Office reinspected this site on January
15,
2004.
The weather conditions during this inspection were sunny and 30°F.
No interviews were
conducted at the time ofthe inspection.
The initial inspection was conducted as a result ofa
citizen complaint.
The site is located at 200 W. Franklin Street, Bement, IL.
Herbert Lust owns the site.
The
mailing address for Herbert Lust is P0 Box
197, Bement, IL 61813.
A copy ofthe deed from the
Piatt County Clerks
Office in Monticello, IL determined the ownership.
Bement Plumbing Supply are builders ofcomplete municipal water supplies, theydo extension
repairs, pressure tap connections, line chlorination, hydrostatic testing, iron filter,
sOftener media,
specialize in roadboring & casing, watertreatment plant work and electronic leak detecting.
This inspection was conducted in ‘accordance with Sections 4(c) and (d) ofthe illinois
Environmental Protection Act (“Act”). The purpose ofthis
inspection was to determine if the site
is in compliance with the Act and Regulations.
JANUARY 15, 2004 INSPECTION FINDINGS
I arrived on the property at
9:55
am.
Iknocked on the door at the office/shop at the site.
Nobody
answered the door.
I walked to the north part of the property and the area ofscattered litter~
inspected at the previous
inspection had been removed from the site (see
photo
1).
I walked west
to
the landscape/waste pile.
I informed Mr. Lust by phone and in person that he could burn the
landscape waste but must remove all litter from the landscape/waste pile.
Mr. Lust informed he
would remove all litter before burning the landscape waste.
The landscape/waste pile had been
burned at the site.
I inspected the’20’ x
15’
x
2 open burnpile and observed ceramic tile,
concrete, bricks, cans, metalpiping, lumber, asbestos piping, shingles, ash and other litter (see
photos
2 thru
5).
The evidence showed that the litter was not removed before the landscape
waste was burned at the site.
I left the site at 10:15 am.

into the environment in any State so as to cause or tend to cause air pollution in Illinois,
either alone or in combination with contaminants from other sources, or so as to violate
regulations or standards adopted by the Board under this
Act.
A violation ofSection 9(a) is alleged for the following reason:
Evidence of open
burning, which would cause or tend to cause air pollution in Illinois was observed
during the inspection.

Pursuant to Section 9(c) ofthe

Environmental Protection Act

no person shall cause or allow the open burning ofrefuse, conduct any salvage operation
by open burning, or cause or allow the burning ofany refuse in any chamber not
specifically designed for the purpose and approved by the Agency pursuant to
regulations
adopted by theBoard under this Act.

operation without a permit grantedby the Agency or in violation ofany condition imposed
by such permit.

a permit granted by the Illinois EPA.
