of the Illinois Environmental Protection Act, 415

FACTS
1.
That
Respondent,
Knox County
Landfill
Committee,
is the permitted
owner and
operator of Knox County Landfill #3,
a facility located in
rural Knox County,
near Wataga, Illinois.
2.
That Respondent,
Greg
Ingles,
is the Certified Operator of the above-referenced
facility.
3.
That
said
facility
is
operated
as
a
sanitary
landfill,
operating
under
Illinois
Environmental Protection Agency Permit No.
1995-337-LF,
and is designated with Site Code
No.
0958160003.
The facility is commonly known to the Illinois
Environmental Protection
Agency as
Knox County Landfill #3.
5.
That Respondents have owned and/or operated said facility at all times pertinent
hereto.

That on
December 12, 2003, Jeffrey Port of the Illinois
Environmental
Protection
Agency’s Peoria Regional Office inspected the above-referenced facility.
A copy of his inspection
report setting forth the results of said
inspection is attached hereto and
made a part hereof.
VIOLATIONS
Based
upon direct observations made byJeffrey Port during the course of his December 12,
2003 inspection of the above-referenced facility, the Illinois Environmental Protection Agency has
determined that Respondents violated
the Illinois Environmental
Protection
Act (hereinafter, the
“Act”) as follows:
(1) That Respondents conducted
a sanitary landfill in a mannerwhich resulted in uncovered
refuse remaining from any previous operating day orat the conclusion of any operating
day, unless authorized by permit,
a violation
of Section
21
(o)(5) of the Act, 415 ILCS
5/21
(o)(5) (2002).
(2)
That Respondents conducted a sanitary landfill operation
in a mannerwhich resulted in
the failure to
collect and
contain litter from the site by the end of the operating
day, a
violation of Section
21(o)(12) of the Act, 415
ILCS 5/21(o)(12) (2002).
CIVIL PENALTY
-
Pursuant
to
Section
42(b)(4) of
the Act,
415
ILCS
5142(b)(4)
(2002),
Respondents
are
-
subject to
a
civil penalty of
Five Hundred
Dollars
($500.00)
for each
of the violations
identified
above, for a total of One Thousand
Dollars
($1000.00).
If Respondents
elect not to petition the
Illinois Pollution Control Board, the statutory civil penalty specified above shall be due and payable
no later than February 16, 2004,
unless otherwise provided by order of the Illinois Pollution Control
Board.

If Respondents elect to contestthis Administrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1
of the Act, 415
I LCS 5/31.1(2002), and if the Illinois.
Pollution Control Board issues a finding of violation as alleged herein, afteran adjudicatory hearing,
Respondents shall be assessed the associated hearing costs incurred by the Illinois Environmental
Protection Agency and the Illinois Pollution Control Board.
Those hearing costs shall be assessed
in addition
to the statutory civil penalty.
Pursuant to Section 31.1 (d)(1) of the Act, 415 ILCS 5/31.1 (d)(1) (2002), if Respondents fail
to petition orelect not to petition the Illinois Pollution Control Board for review of this Administrative
Citation within thirty-five (35)
days of the date of service, the Illinois
Pollution Control
Board shall
adopt a
final order,
which shall
include this Administrative
Citation. and
a
finding
of violation
as
alleged herein, and
shall impose the statutory civil penalty specified above.
When
payment
is
made,
Respondents’
check
shall
be
made
payable
to
the
Illinois
Environmental
Protection
Trust
Fund
and
mailed
to
the
attention
of
Fiscal
Services,
Illinois
Environmental Protection Agency,

Along with
payment,
Respondents shall complete and return
the enclosed
Remittance Form to ensure proper documentation of payment.
Ifany civil penalty and/or hearing
costs are not paid within the time prescribed by order of
the Illinois Pollution Control Board, interest on said penalty and/or hearing costs shall be assessed
againstthe Respondents from the date payment is due up to and including the date that payment is
received.
The
Office
of the
Illinois Attorney General
may be
requested
to
initiate
proceedings
against Respondents in Circuit Court to collect said penalty and/or hearing costs, plus any interest
accrued.

Affiant is a field inspector employed by the Land
Pollution Control Division of the Illinois Environmental
Protection Agency and has been so employed at all times
pertinent hereto.

On December 12,
2003, between 5:53 AM and 10:10 AM,
Affiant conducted an inspection of the
Knox
County Landfill in
Knox
County,
Illinois,
known
as
Knox
County Landfill #3,
Illinois Environmental Protection Agency Site No.
0958160003,
operating under IEPA Permit #1994-105-LFM.

Affiant inspected said Knox County Landfill #3 site by
an on—site inspection,
which included w~lkingthe site and
interviewing personnel.
4.
Before and/or after said inspection of said landfill
site, Affiant reviewed Illinois Environmental Protection Agency
permits issued to the subject site and investigated into wheth~r
or
not
required
documents
were
timely
filed
on
behalf
of
the
subject site.
5.
As a result of the activities referred to in
Paragraphs
3 and 4 above, Affiant completed the Inspection Report
form attached hereto and made a part hereof,
which, to the best
of Affiant’s knowledge and belief,
is an accurate representation
of Affiant’s observations and factual conclusions with respect

The
facility
is
an
814 Subpart
C
landfill with
authorization under Permit
#1994-105-
LFM
issued
on
September
29,
1994.
The
most
recent
modification,
#19
was
issued
on
November
19,
2003.
As part of the Pre-operation
Permit Inspection for Permit
Log No. 2003-
412,
I needed to
examine the liner, leachate drainage and collection
systems,
and surface water
control structures.
I arrived at the site at
5:53
AM.
The
gate to the facility was locked as
seen
in photograph P1.
Photograph P2 shows
the facility’s signage.
At approximately 7:43
AM,
a vehicle approached
and
opened
the
exit
gate.
I waited
for the
entrance
gate
to
be
opened.
At
approximately
7:52
AM, I proceeded onto the site through the exit gate.
I entered the facility’s office and asked
to speak with the operator.
I was introduced to Greg Ingles.
I explained to
Mr. Ingles that I was
the new inspector for the site and I needed to perform a pre-operation permit inspection as well
as a solid waste
landfill inspection.
Mr. Ingles
directed me to
the facility’s active area, but did
not
accompany me
during the inspection.

observed uncovered
refuse
from
a previous
operating
day here.

newly developed Cell 9.

appeared
to
have
fallen
and
waste
from
cells

and

was
observed

consistent
with
the application
and
that
additional workneeded to be performed.
After photographing this area, I performed a Permitted
Compost Facility Inspection at the adjacent compost facility (0950600001).
That inspection is
under
another cover.
After
the
compost
facility
inspection,
I returned
to
the
office where

Mr.
Ingles.
I also
examined the load checks
for the
landfill
and
found
these
items to be in order.
After further discussion with Mr.
Ingles, I left the site at 10:10 AM.

inspection,
the following violations were found to be continuing.

waste-
disposal
operation
without
a
permit
granted
by
the
Agency

conditions imposed by such permit.
