    regulations files the following Recommendation regarding the tax certification of air pollution
    control facilities pursuant to 35 Iii.

    On April 4,

    the Illinois EPA received a request from Exxon-Mobile Oil
    Corporation for an Illinois
    EPA recommendation regarding the tax certification of air
    pollution control facilities pursuant to
    35
    Ill. Adm.
    Code
    125.204,
    and noted the
    request as log number TC-02-04-04.

    Equipment whose primary purpose is to remove sulfur

    compounds
    in the production of gasoline and to
    meet the US EPA Tier 2
    Motor
    Vehicle Emission Standards
    and Gasoline Sulfur
    Control Requirements,
    reducing S02 Emissions once the gasoline is
    consumed.
    This is done
    by
    increasing the capacity ofexisting
    desulfurization units
    (the Pretreater and
    Hydrofmisher Units)
    and by
    installing a new Selective Hydrogenation Unit and
    Naphtha Splitter.
    Improvements must also be made to the
    South Sulfur
    Recovery Plant,
    i.e., addition of two
    additional conversion beds (one per train),
    to
    handle the additional sulfur.
    Because the primary purpose ofthis system is to
    reduce or eliminate air pollution,
    it is
    certified as
    a pollution control facility.

    11-10 of the Property
    Tax Code,
    35
    ILCS 200/11-10 (2000), defines “pollution
    control facilities”
    as:
    “any system,
    method,
    construction,
    device or appliance
    appurtenant thereto or any portion of any building or equipment, that
    is designed,
    constructed,
    installed or operated for the primary purpose of:
    (a) eliminating,
    preventing,
    or reducing air or water pollution
    .

    .or (b) treating, pretreating, modifying
    or disposing ofany
    potential solid,
    liquid
    or gaseous pollutant which if released without
    treatment,
    pretreatment modification or disposal might be harmful,
    detrimental or
    offensive to human, plant or animal life,
    or to property.”

    Pollution control facilities are entitled
    to preferential tax treatment,

    Based on the information in the application and the purpose of the facilities,
    to prevent,

    eliminate or reduce air pollution, it is the Illinois
    EPA’s engineering judgment that the
    described facilities may be considered “pollution control facilities,” pursuant to
    35 Ill.

    with the primary purpose of eliminating, preventing,
    or
    reducing air pollution, or as otherwise provided in 35 Ill.

    The process will enable the Joliet refinery to produce gasoline which will comply with
    federal regulation “Tier 2 Motor Vehicle Emissions
    Standards and Gasoline Sulfur
    Control
    Requirements” by hydrotreating and
    desulfurizing the gasoline.
    The project
    consists of adding
    a new Selective Hydrogenation
    Unit and a Naphtha Splitter to
    treat and split FCC and Coker Naphtha.
    One stream from the Naphtha Splitter will
    0
    go directly to storage.
    Other draws from the Naphtha Splitter will go to the expanded
    HDF Unit and/or SGP before going to storage/blending.
    The remaining stream(s) will
    go to the PreTreater and then CCR prior to going to storage/blending.

    Units for the required treatments, and to provide sufficient blend material for octane
    uplift necessary to offset the octane loss
