The water pollution control facilities in this request are located at Section 22, Township
7N, Range 8E ofthe

Prime Meridian,
in Jasper County at the above address, and
consist of the following livestock waste management facilities:
•
two concrete manure pits (each 10 ft. x 35 ft. x
1.5
ft. deep) with 2 manure pull
plugs per pit and the slotted concrete portion of the flooring over the manure pits
located in swine building A;
•
four concrete manure pits (each 7 ft. x 30 ft. x
2 ft. deep) with I manure pull plug
per pit and the slotted wire portion ofthe flooring over the manure pits located in
swine building A;
•
one concrete manure pit (10 ft. x
98 ft. x
8 ft. deep) with one concrete manure
pump-out box (4 ft. x
4 ft. x
8 ft. deep) and the slotted concrete flooring over the
manure pit located in swine building A;
•
one concrete manure pit (10 ft. wide x

approximately 148 feet of 10-inch diameter PVC manure transferpipe.

Section 11-10 ofthe Property Tax Code,
35 ILCS 200/11-10 (2000), defines “pollution
control facilities” as:
“any system, method, construction, device or appliance appurtenant thereto or any
portion ofany building or equipment, that is designed, constructed, installed or
operated for the primary purpose of:
(a) eliminating, preventing, or reducing air
orwater pollution
.

or (b) treating, pretreating, modifying or disposing ofany
potential solid, liquid or gaseous pollutant which if released withouttreatment,
pretreatment modification or disposal might be harmful, detrimental or offensive
to human, plant oranimal life, or to property.”

Pollution control facilities are entitled to preferential tax treatment, 35 ILCS 200/11-5
(2000).

Based on the information in the application and the purpose ofthe facilities, to collect,
transport and/or store livestock wastes prior to cropland application, it is the Illinois
EPA’s engineeringjudgment that the described facilities may be considered “pollution
control facilities,” pursuant to 35 Ill.
Adm.
Code 125.200(a), with the primary purpose of
eliminating, preventing, or reducing waterpollution, or as otherwise provided in 35
Ill.
Adm.
Code
125.200 and therefore are eligible for tax certification from the Board.

WHEREFORE, the Illinois EPA recommends that the Board issue the requested
tax certification.
