That
the Everett
C. Glover Trust do Rebecca Cloney, Trustee (“Respondent”) is the
present owner of a facility located
about
4
miles east of Raymond
along the Nokomis-Raymond
Blacktop (County Road 2100 N), Montgomery County, Illinois.
The property is commonly known to
the Illinois Environmental Protection Agency as Raymond Township/Everett GloverTrust Property.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating Permit and is designated with Site Code
No.
1358125002.
3.
That Respondent has owned
said facility at all times pertinent
hereto.
4.
That
on
November
14,
2003,
Richard
C.
Johnson
of
the
Illinois
Environmental
Protection Agency’s Springfield Regional Office inspected the above-described facility.
A copy of
his inspection
report setting forth the results
of said inspection is attached hereto:an.d:mad~.apart

VIOLATIONS
Based
upon direct observations
made
by Richard
C.
Johnson
during
the
course
of his
November
14, 2003 inspection
of the above-named facility, the Illinois Environmental Protection
Agency
has
determined
that
Respondent
has
violated the Illinois
Environmental
Protection
Act
(hereinafter, the “Act”) as follows:
(1)
That
Respondent caused
or allowed the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of
Section
21(p)(1)
of
the Act, 415
ILCS
5/21(p)(1)
(2002).
CIVIL
PENALTY
Pursuant to
Section
42(b)(4-5). of the Act, 415
ILCS
5/42(b)(4-5)
(2002),
Respondent
is
subject
to
a
civil
penalty of
One
Thousand
Five
Hundred
Dollars
($1,500.00)
for
each
of
the
violations
identified
above,
for
a
total
of
One Thousand
Five
Hundred
Dollars
($1,500.00).
If
Respondent elects
not to
petition
the Illinois
Pollution
Control
Board, the statutory
civil penalty
specified above shall be due and
payable no later than January 30, 2004, unless otherwise provided
by order of the Illinois Pollution Control Board.

On November
14, 2003, I conducted
a re-inspection ofthe above-referenced property
located about 4 miles
east of Raymond along the Nokomis-Raymond Blacktop (County
Road 2100N). My last inspection ofthe site was conducted March
13, 2003.
The Illinbis Environmental Protection AgenCy originally received a complaint concerning
the site on January 22, 2001. An anonymous complainant alleged there were old
-campers/trailers, old vehicles, and a dilapidated house on the property. Based on the
original investigation conducted February
8, 2001
at the site, a Violation Notice dated
March
7,
2001
was sent to the Everett C.
Glover Trust (hereafter referred tc~
as the Trust)
-citing apparent violations ofthe Illinois Environmental Protection Act. Ms. Becky
Cloney, representing the Trust, responded to the Violation Notice in a letter dated April
30, 2001.
In the letter she indicated that her father Everett C.
Glóver had died on -March
6, 2001, and that she and her brothers were t-rying to comply with the VN.
In letter dated
May
15,
20Q1, the Illinois
EPA acknowledged receipt ofMs.
Cloney’s letter and stated
-that the timely implementation of the recommendations in the VN would resolve the
matter, but asked for a followup letter with achievable timeframes. In a letter dated
January 29, 2002, the Illinois EPA agreed to an
extension ofJuly 31, 2002,
for the site to
be cleaned up. A follow up inspection ofthe site was conducted October 8, 2002
in which
Ms. Cloney was sent an Illinois EPA letter dated October 31, 2002.
She didn’t reply to
the October 31, 2002 letter, however, sli~
did reply to the Agency’s March 28, 2003 letter
generated from the March
13, 2003
inspection. Ms. Cloney’s April 30, 2003
letter
requested another exten~ion
to clean up the
site.- until November 1, 2003.
She also
provided a signed Consensual Tire Removal Agreement to allow the Agency to collect
and recycle the used tires at the site. The Illinois EPA informed Ms.
Cloney that-the
November 1, 2003 deadline to complete cleanup ofthe property was acceptable in a letter
dated June 6, 2003.
Branna LLC -(a used tire contractor hired by the Illinois
EPA)
collected
over 300 used car, truck, and tractor tires from the site some time between July
1,
2Q03 and September
15, 2003.
November 14, 2003 Inspection
I arrived onsite at

-1:15
am. The temperature was about 40°F,it was cloudy, and the
soil
was dry.
As Ibegan the investigation, I observed a pickup truck with an older male in the eastern
region ofthe site. Mr. I-Tarry Ruemmler (telephone 217/229-3146) was met and
interviewed. AccOrding to Mr. Ruemmier, the Glover family gave him permission to
enter the property and pick up scrap metal
He indicated “Chip” House ofRaymond has
been coordinating part ofthe site’s clean up
He was initially reluctant to give his name
Or give other information, but he quickly became more open to my questions. Mr.

Ruemmler said this was his first day at the property to collect scrap metal. His activities
are limited given his age (he’s retired), the type ofscrap that was available, and the size
ofhis truck (a pickup truck). The tin
and iron metal objects have to be light enough for
him to lift
into the back ofthe pickup truck. His plan is to remove parts offoffarm
implements and other large items at the site for scrap. He didn’t propose using a cutting
torch because ofthe expense of a cylinder ofacetylene,
and the relatively low return on
the metal scrap when sold to
a metal recycler. He did say that one ofthe older trucks and
tractors setting on the east side of the property probably had some value to a person
collecting vintage items. In fact, as we were talking someone came by in a pickup truck
and inquired whether one ofthe farm implements was for sale. The Glover family
apparently has been trying to
sell some of the farm implements and other things at the site
ratherthan having a scrap metal company come and remove all the metal junk.
It is believed that there were less junk vehicles and farm implements
on the
property than on the previous inspection.
But while there
was less
apparent waste at
the property, it had not all been cleaned up
by November
1, 2003
as requested by
Ms. Cloney and agreed to by the Illinois EPA.
Ms.
Cloney hired Sheppard Brothers Auto
Sales in or around April 2002 to remove scrap
metal at the site. On April
8,
2002, Mr. Bill Gonet ofthe Montgomery County
Coordinated Services Office investigated an open burning complaint
at the Glover Trust
property. Mr. Gonet observed two areas ofburning waste and met Mr.
Bob
Sheppard at
the site. Mr. Sheppard denied any knowledge or involvement in the waste burned.
Ms.
Cloney’s agreement with the Sheppard
Brothers Auto Sales allowed them to remove
scrap metal from the site. The cleanup done by Sheppards was apparently limited to
removingjunk vehicles.
An un-occupied, dilapidated house with transite siding sets near the center ofthe property
(see photograph 4). On the eastern boundary ofthe property is a Quonset hut-type
building (see photograph 1). West and south ofthe building are a few remaining vehicles,
farm implements,
and other
items (see photographs 2, 3,
5,
6,
7,
8, 9,
10 and 11). The
west side ofthe property appears the same as the March 14, 2003 inspection, except that
a large pile ofused tires previously setting in the area has been removed by Branna LLC.
My reinvestigation started at the east end of the site and proceeded to the west. One of the
first areas inspected was the Quonset hut-type building.
The same items inside the
building were again found. These include: car engine belts, a few tires, furniture, house
insulation,
riding mowers, brush mowers, an
old car, empty 5-gallon metal cans of
herbicide and an assortment of other materials. The building
is still in fairly good shape.
An antique truck was setting just west ofthe Quonset hut-type building (see photograph
2). Mr. Ruemmler thought this would still have some value for a collector. Waste along
the northwest side ofthe building included a metal fuel tank, about
5 used tires and scrap
metal (see photos 2,

and 6). Photos 7 and 8
show an old tractor (said to have value by
Mr. Ruemmler), a metal fuel tank setting up on metal legs, an old combine,
and other
items further south
along the west side of the building.

There are still a considerable number of farm implements setting around the site (see
photos
2, 3, 7, 8, 9,
10,
12 and 13). These included a couple ofcombines, a tractor, old
discs, old-balers, old rakes,
old planters, etc. A rough estimate ofthe number offarm
implement type items onsite is around
15.
Near the southern property line were two boats setting on the ground, and another was
found southwest ofthe house. Photo
14 shows a pile ofscrap metal and about 20 used
tires -located in the southcentral region of the site. Southwest ofthe house and garage
were two -metal tanks and about 25 used tires (see photo
16). Photo

rear-end and a few used tires were observed.
In the southwest corner ofthe site was
another pile ofabout 25 used tires (see photo
19).
Near the southwest corner ofthe property, in among the trees, were bundles ofmetal
farm fencing, metal scrap (metal ducts), and broken concrete (see photo 20).
The trailers
and campers are gone from the northwest corner ofthe site. In among the
high weeds in this area were an estimated 20 used tires.
Photos 21
and 22 show a cleared area in the western region of the site. On walking
towards the house to
the east I encountered about 30 used tires setting on the ground at
the base ofa tree.
In all, I estimated about 150
used tires remain on the ground at the property.
I left the site ~t 1-2:05 p.m.
