FACTS
1.
That Respondent (Larry Lord) is the present owner and operatorof a facility located
approximately three miles south of Sparland, off Illinois Route 29, in
Marshall County,
Illinois.
The
property
is commonly known to
the
Illinois
Environmental
Protection
Agency as Sparland/Lord
Property.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating Permit and is designated with Site Code No. 1238105001.
3.
That Respondent has owned and operated said facility at all times pertinent hereto.
4.
That
on
November
26,
2003,
Jeff
Port
of
the
Illinois
Environmental
Protection
Agency’s Peoria
Regional
Office inspected the above-described facility.
A
copy of his
inspection
report setting forth the results of said inspection is attached hereto and
made a part hereof.
VIOLATIONS
Based upon direct observations made
by Jeff Port during the course
of his November26,
I
2003 inspection
of the
above-named facility, the
Illinois
Environmental
Protection
Agency
has
determined that Respondent has violated the Illinois Environmental Protection Act (hereinafter, th~
“Act”) as follows:
(I)
That
Respondent caused
or allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a violation
of
Section
21(p)(I) of the Act,
415
ILCS 5/21(p)(I)
(2002).
(2)
That
Respondent caused
or
allowed
the
open
dumping
of waste
in
a
manner
resulting
in
deposition
of
general
construction
or
demolition
debris
or
clean
construction ordemolition debris, a violation of Section 21 (p)(7) of the Act, 415 ILCS
5/21 (p)(7) (2002).
CIVIL PENALTY
Pursuant to Section 42(b)(4) of the Act, 415 ILCS 5/42(b)(4) (2002), Respondent is subject
to
a
civil penalty of One Thousand
Five
Hundred
Dollars
($1,500.00) for
each
of
the violations
identified
above, for a total of Three
Thousand
Dollars ($3,000.00).
If Respondent elects
not to
petition the Illinois Pollution Control
Board, the statutory civil penalty specified
above shall be due
and
payable
no
later than
February
15, 2004,
unless otherwise
provided
by order of the Illinois
Pollution Control Board.
IfRespondent elects to contest thisAdministrative Citation~by
petitioning the Illinois Pollution
Control Board in accordance with Section 31.1 of the Act, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board
issues a finding of violation as alleged

Narrative
On July
11,
2003,
I
(Jeff Port)
performed
a
follow-up
inspection
at
the
Larry Lord
property
located south of Sparland on Illinois Route 29.
The purpose ofthis
inspection was to determine
if
compliance
had
been
achieved
with
respect
to
violations
cited
in
an
April
10,
2002,
Administrative
Citation Warning Notice.
These violations
were observed during
inspections
on
March
22, 2002 and July
11,
2003.
I arrived at the site at
11:09 AM.
The weather was sunny and cold, approximately 35 °F. I was
accompanied by R.
Eugene Figge, DLPC/FOS-Peoria.
No one was present at the property.
We
began
walking
around
the
property
and
located
several
areas
where
waste
tires
had
been
accumulated.
These tires
had
been observed
during
previous
inspections.
Additionally, open
dumped domestic
and
demolition
waste
was
observed
as
well
as
open dumped
white goods.
Photographs P1, P3, P4,
P6, P7, P9, and PlO show the waste tires.
Photographs P2
and P8 show
the domestic waste
and demolition waste.
Photograph PS
shows the white goods present on the
site.
It
appeared
that
no
waste
material
had
been
removed from
the
site
since the
previous
inspection.
After photographing the site we left at
11:30 AM.
Photograph locations
are depicted
on
the accompanying site map.
Based upon
this inspection,
the following continuing
violations were observed.

Pursuant
to
Section
12(a)
of the
Illinois
Environmental
Protection
Act
(415

5/12(a)),
no
person
shall
cause
or threaten
or allow the discharge of any
contaminaints
into
the
environment
in
any
State
so
as
to
cause or tend
to
cause
water pollution
in
Illinois,
either
alone or in combination with matter from other sources, or so as to violate
regulations or standards adopted by the Pollution Control Board under this
Act.
