    ORDER OF THE BOARD (by N.J. Melas):
    Today’s order concerns a motion to disqualify Attorney Claire Manning from
    representing Town and Country Utilities, Inc. (Town & Country) in this proceeding filed by the
    County of Kankakee, Illinois and Edward D. Smith, Kankakee County State’s Attorney (County)
    on December 2, 2003. Hearing Officer Brad Halloran, in an order dated December 3, 2003, gave
    the parties until December 9, 2003, to respond to the motion. Ms. Manning responded to the
    motion on December 9, 2003. On December 15, 2003, Ms. Manning filed a notice of withdrawal
    as counsel on behalf of Town & Country in accordance with Section 101.400(b) of the Board’s
    procedural rules. 35 Ill. Adm. Code 101.400(b). Accordingly, the Board denies the County’s
    motion to disqualify as moot.
    IT IS SO ORDERED.
