United States Environmental Protection Agency Proposes Amendments to the Transportation Conformity
Rule for the New 8-Hour Ozone and PM2.5 National Ambient Air Quality Standards Under the Clean Air Act
On November 5, 2003 (68 Fed. Reg. 62689), the United States Environmental Protection Agency (USEPA)
proposed amendments to the transportation conformity rule for the new National Ambient Air Quality Standards for
8-hour ozone and fine particulate matter (PM2.5).
Transportation conformity is required under Section 176(c) of the federal Clean Air Act to ensure that federally-
supported highway and transit project activities are consistent with the purpose of a State air quality implementation
plan (SIP). The proposal provides guidance for when conformity will first apply in areas that are designated
nonattainment for the 8-hour ozone and PM2.5 standards. The proposal discusses the implementation of the
statutory one-year conformity grace period and proposed revocation of the 1-hour ozone standard, although USEPA
is not seeking comment on the revocation options themselves. This proposal also describes when transportation
conformity applies in areas that have approved 8-hour ozone Early Action Compacts. The proposal also describes
the general requirements for conducting conformity determinations for the new standards, such as the conformity
test(s) that would apply before and after adequate or approved SIP motor vehicle emissions budgets are established.
In addition, this rulemaking proposes to amend the conformity regulations to specifically include PM2.5 as a criteria
pollutant subject to transportation conformity and outlines the specific conformity requirements that would apply in
newly designated PM2.5 nonattainment areas. In particular, the proposal includes options for when conformity
would apply for various PM2.5 precursors and fugitive dust, as well as options for PM2.5 hot-spot requirements for
project-level conformity determinations.
Written comments on this proposal must be received on or before December 22, 2003. USEPA will conduct one
public hearing on this proposal beginning at 9:30 a.m. on Thursday, December 4, 2003, in Washington, DC.

United States Environmental Protection Agency Publishes Notice of Final Action on Reconsideration of
Amendments to Final Rules for the Prevention of Significant Deterioration and Non-Attainment New Source
Review
On November 7, 2003 (68 Fed. Reg. 63021), the United States Environmental Protection Agency (USEPA)
announced its final decision in response to petitions it had received to reconsider certain issues arising from the final
rules of December 31, 2002 that implemented revisions to the New Source Review (NSR) programs. USEPA
agreed that two of the issues merited further action, but that the rest did not.
On December 31, 2002 and March 10, 2003, USEPA revised regulations governing the major NSR programs
mandated by parts C and D of title I of the Clean Air Act. Following these actions, the Administrator received a
number of petitions for reconsideration. On July 30, 2003, USEPA announced its reconsideration of certain issues
arising from the final rules of December 31, 2002. As a result of this reconsideration process, USEPA concluded
that two clarifications to the underlying rules were warranted. USEPA decided to: (1) include a definition of
“replacement unit,” and (2) clarify that the plantwide applicability limitation baseline calculation procedures for
newly constructed units do not apply to modified units. USEPA denied the requests for reconsideration for all of
the other issues raised by the petitioners.
This final action is effective on January 6, 2004.

United States Environmental Protection Agency Adopts National Emission Standards for Hazardous Air
Pollutants for Miscellaneous Organic Chemical Manufacturing Facilities Under the Clean Air Act
On November 10, 2003 (68 Fed. Reg. 63851), the United States Environmental Protection Agency (USEPA)
adopted National Emission Standards for Hazardous Air Pollutants (NESHAP) for miscellaneous Organic Chemical
Manufacturing facilities.
The final rule establishes emission limits and work practice standards for new and existing miscellaneous organic
chemical manufacturing process units, wastewater treatment and conveyance systems, transfer operations, and
associated ancillary equipment and implements section 112(d) of the Clean Air Act by requiring all major sources to
meet hazardous air pollutants emission standards reflecting application of the maximum achievable control
technology. The HAP emitted from miscellaneous organic chemical manufacturing facilities include toluene,
methanol, xylene, hydrogen chloride, and methylene chloride. Exposure to these substances has been demonstrated
to cause adverse health effects such as irritation of the lung, eye, and mucous membranes, effects on the central
nervous system, and cancer. The final rule will reduce HAP emissions by 16,800 tons per year for existing facilities
that manufacture miscellaneous organic chemicals.
This rule is effective November 10, 2003.

Rule Update
Board Timely Adopts Second Notice Opinion and Order in Brownfields Site Restoration Program,
Amendments To 35 Ill. Adm. Code 740 (R03-20)
On November 6, 2003, the Board adopted a second notice opinion and order in Brownfields Site Restoration
Program, Amendments To 35 Ill. Adm. Code 740 (R03-20). The Board has sent the rulemaking, pursuant to the
Illinois Administrative Procedure Act (5 ILCS 100/1-1
et seq.
(2002)), to the Joint Committee on Administrative
Rules (JCAR) for its review and approval. The proposed amendments will be considered at the December 16, 2003
JCAR meeting. The Board did not make any substantive changes to the proposal it adopted for first notice on July
10, 2003 (published in the
Illinois Register
at 27 Ill. Reg. 11879 (July 25, 2003)).
This rulemaking was initiated by a proposal filed on February 18, 2003 by the Illinois Environmental Protection
Agency (IEPA) to establish procedures and standards for administering the Brownfields Site Restoration Program
(BSRP). The proposal implements 2002 amendments to Title XVII of the Act, adding Section 58.15. In adopting
the second notice opinion and order on November 6, 2003 the Board took timely action, within 9 months of the
filing of the IEPA’s proposal, as required by Section 58.15.
For BSRP reimbursement under the new Subpart I, Remediation Applicants (RA) must apply to both the IEPA and
the Department of Commerce and Economic Opportunity (DCEO), and pay associated application fees totaling
from $2,000 to $2,500 per site. The fee is $1,000 per site for eligibility reviews conducted by the DCEO. The fee
is $1,000 fee per site per application for review of remediation costs conducted by the IEPA, and $500 per site per
preliminary review of the budget plan, also conducted by the IEPA.
Generally, to be eligible for reimbursement, an RA must have been issued a No Further Remediation (NFR) Letter
under the Site Remediation Program, must have recorded the NFR Letter, and must not have materially caused or
contributed to the contamination. The RA also must apply for and receive a DCEO letter: (1) determining that the
RA is eligible for reimbursement because the site qualifies as either “abandoned property” or “underutilized
property”; (2) setting forth the remediation’s “net economic benefit” to the State based on factors such as capital
investment and job creation; and (3) providing the maximum amount the RA may be reimbursed. DCEO approval
is required before any costs are incurred.
Reimbursement is subject to funds available in the Brownfields Redevelopment Fund for the BSRP each fiscal year,
and funds are distributed based on the order applications for reimbursement are received. In addition, an RA cannot
be reimbursed more than the lowest of the following: (1) $750,000 in remediation costs at the site; (2) 20% of the
capital investment at the site; or (3) the net economic benefit to the State of the remediation.
Under the BSRP, the IEPA must make a final determination within 60 days of receipt of a reimbursement
application. Submittal of a budget plan automatically waives the remedial action plan deadlines for an additional 60
days. The DCEO will establish its own timeframe for making the eligibility determination. Furthermore,
amendments to the application or the budget plan restart the IEPA’s time for review.
The Board held hearings in this rulemaking on April 30, 2003, in Springfield and on May 14, 2003, in Chicago.

Board Adopts Final Opinion and Order in Radionuclide Restricted Status, Amendments to 35 Ill. Adm. Code
602.105, 602.106, 602.108, and 602.115

On
November 6, 2003, the Board adopted a final opinion and order in Radionuclide Restricted Status, Amendments
to 35 Ill. Adm. Code 602.105, 602.106, 602.108, and 602.115 (R03-21). The Board did not make any substantive
changes to the first notice proposal, adopted on June 19, 2003 (published in the
Illinois Register
at 27 Ill. Reg. 9895
(July 7, 2003)). The rulemaking was filed with the Secretary of State’s office and will be published in the
Illinois
Register
on December 1, 2003 with a November 12, 2003 effective date.
Section 17.6 of the Illinois Environmental Protection Act (Act) provides that the Illinois radiological quality
standards must be the same as the federal standards adopted by the United States Environmental Protection Agency
(USEPA) (415 ILCS 5/17.6 (2002). That standard, as codified in the Board’s rules, is 5 pico curies per liter (pCi/l)
for combined radium-226 and radium –228 and 15 pCi/l for gross alpha particle activity. 35 Ill. Adm. Code
611.330. The federal compliance date is December 8, 2003.
The final amendments allow the Illinois Environmental Protection Agency (IEPA) to continue issuing permits to
Public Water Supplies (PWS) that do not meet the federal radionuclide standard for drinking water, but only if the
PWS is bound by an enforceable order or agreement to a compliance schedule for meeting the federal standard. The
rules do not exempt PWS from the final radionuclide standard, but would continue the existing State exemption that
keeps certain PWS from being placed on “restricted status” (
i.e.
, an Illinois-only list of PWS banned from receiving
construction permits).
In its April 7, 2003 proposal of these rules, IEPA anticipated that approximately 50 to 60 PWS may fail to meet the
December 8, 2003 deadline and be subject to the pre-enforcement processes of Section 31 of the Act. However,
IEPA maintains that those PWS meeting compliance dates of Compliance Commitment Agreements (CCAs) or
court orders should be able to avoid restricted status without having to individually petition the Board for variance
relief, expending PWS, Board, and IEPA resources. Accordingly, the IEPA requested, and the Board has acted to
ensure, that the final regulations in this rulemaking be effective by the December 8, 2003 deadline.
Additionally, the final amendments contain language that would require each person signing a construction permit
application for a PWS to certify that the information in the application is complete and accurate and that the text has
not been altered from the IEPA’s permit application form or template.
The Board held hearings in this rulemaking in Springfield on May 8, 2003 and in Chicago on May 15, 2003.

Board Adopts First Notice Opinion and Order in Proposed Site Specific Regulation Applicable to Ameren
Energy Generating Company, Elgin, Amending 35 Ill. Adm. Code Part 901 (R04-11)
On November 6, 2003, the Board adopted, without commenting on the merits of the proposal, a first notice opinion
and order in Proposed Site Specific Regulation R04-11 Applicable to Ameren Energy Generating Company, Elgin,
Amending 35 Ill. Adm. Code Part 901 (R04-11). This site-specific rulemaking was filed with the Board by the
Ameren Energy Generating Company (Ameren) on October 28, 2003, to amend the Board’s noise regulations with
respect to the operation of Ameren’s electric generating facility in Elgin, Cook County.

In its filing, Ameren requested that the Board expedite consideration of this rulemaking. The Board therefore filed
the rulemaking with the Secretary of State’s office for first notice publication without commenting on the merits of
the proposal. The first notice proposal was published in the
Illinois Register
on November 21, 2003 at 27 Ill. Reg.
17349.
In its petition for this rulemaking, Ameren asserts that the Board’s noise regulations are not currently applicable
because the land uses in the immediate area are primarily Class C: industrial, agricultural, mining and excavation.
Additionally, Ameren asserts that the facility is in compliance with the current applicable noise regulations at 35 Ill.
Adm. Code Part 901.
The land immediately to the west of the facility is vacant, and until very recently was located within unincorporated
Cook County and zoned industrial. On June 3, 2003, the Village of Bartlett annexed and rezoned this land for
residential use at the request of Realen Homes, a residential development corporation. Ameren has concluded that
the facility will not be able to meet the Class A noise limitation at 35 Ill. Adm. Code 901.102, that heretofore were
not applicable. Accordingly, Ameren is seeking a site-specific rule that establishes noise emission limitations for
the facility that are applicable to Class A and B receiving lands.
A hearing is scheduled in this rulemaking for December 17, 2003.

Board Adopts Proposal for Public Comment in Wastewater Pretreatment Update, USEPA Amendments
(January 1, 2003 through June 30, 2003), R04-01
On November 6, 2003, the Board adopted a proposal for public comment in Wastewater Pretreatment Update,
USEPA Amendments (January 1, 2003 through June 30, 2003) (R04-01). The rulemaking proposes amendments to
the Illinois regulations that are “identical in substance” to drinking water regulations adopted by the United States
Environmental Protection Agency (USEPA). These are rules adopted by the USEPA pursuant to sections 307(b),
(c), and (d) and 402(b)(8) and (b)(9) of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C. §§ 1317(b),
(c), and (d) and 1342(b)(8) and (b)(9) (1994)). Section 13.3 also provides that Title VII of the Act and Section 5 of
the Administrative Procedure Act (APA) (5 ILCS 100/5-35 and 5-40 (2002)) do not apply to the Board’s adoption
of identical-in-substance regulations. The federal wastewater pretreatment regulations are found at 40 C.F.R. 400
through 499.
As explained in detail below, the substantive amendments involved in this proceeding include adding wastewater
pretreatment portions of the USEPA regulations on concentrated animal feeding operation (CAFO) facilities, and
amending the effluent limitations guidelines and standards applicable to the Pharmaceutical Manufacturing Point
Source Category.
The Board presently intends to adopt final amendments based on this proposal by January 22, 2004.
Amended Standards for CAFO Facilities--Subpart M of Part 307
The USEPA action of February 12, 2003 (68 Fed. Reg. 7176), is related to discharges from CAFO facilities. The
primary emphasis of the CAFO rule is the control of water pollution from animal manure. The rules include animal
confinement areas, manure containment facilities, land application of animal wastes, and stormwater runoff from
facilities. In broad terms, the applicability of the CAFO rule is determined by a combination of facility size and the
facility’s capacity to discharge pollutants. USEPA divided the universe of animal feeding operations (AFOs) into
three categories based on size. The number of animals that the facility manages determines the AFO size. A large
AFO is designated by rule as a CAFO that is subject to regulation. A medium AFO is designated by rule as a
CAFO that is subject to regulation if it discharges pollutants to waters of the United States. The USEPA (or an

authorized State) may designate a small AFO as a CAFO that is subject to regulation based on its determination that
the facility is a significant contributor of pollutants to waters of the United States in light of specified
considerations.
Most of the substance of the federal CAFO rules is beyond the scope of the Board’s identical in substance
rulemaking authority, since only a small segment relates to wastewater pretreatment. Under 40 C.F.R. 412.3
(corresponding with 35 Ill. Adm. Code 307.2201(c)), any CAFO that discharges process wastewater into the
collection system of a publicly owned treatment works must comply with the general pretreatment standards of 40
C.F.R. 403 (corresponding with 35 Ill. Adm. Code 310). The only sub-category for which USEPA established
specific pretreatment standards was subpart B of 40 C.F.R. 412 (corresponding with 35 Ill. Adm. Code 307.2202),
applicable to new wet lot and dry lot duck CAFOs. That standard, however, is no more specific than to prohibit
discharge of pollutants from these facilities into the waters of the United States, except runoff from a 25-year, 24-
hour rainfall event.
The Board proposes to incorporate the wastewater pretreatment segments of the federal CAFO amendments without
substantive deviation from the corresponding federal text.
Amended Standards for Subcategories of the Pharmaceutical Manufacturing Point Source Category--
Subpart BN of Part 307
On March 13, 2003 (68 Fed. Reg. 12266), USEPA adopted a direct final rule that amended the effluent limitations
guidelines and standards applicable to the Pharmaceutical Manufacturing Point Source Category. USEPA partially
withdrew the March 13, 2003 direct final rule on June 11, 2003 (68 Fed. Reg. 34831). USEPA stated that the intent
of the amendments was to clarify rules published on September 21, 1998 (at 63 Fed. Reg. 50424). The first
clarification related to the effective date for the standards applicable to new sources. The second clarification was
to establish an average 5-day biochemical oxygen demand (BOD5) limitation omitted from the 1998 rule. Finally,
the amendments corrected an error in USEPA’s pass-through analysis and deleted methyl cellosolve from the
pretreatment standards. USEPA stated that its amendments also included a number of non-substantive editorial and
format changes. The June 11, 2003 partial withdrawal related to the new source effective dates.
The Board proposes to incorporate the March 13, 2003 and June 11, 2003 federal amendments relating to the
Pharmaceutical Manufacturing Point Source Category.

Restricted Status List -- Public Water Supplies
The Restricted Status List was developed to give additional notification to officials of public water supplies which
are in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental
Protection Act.
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a
violation of any of the following requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604,
Subparts B and C; maintenance of adequate pressure on all parts of the distribution system under all conditions of
demand; meeting raw water quantity requirements of 35 Ill. Adm. Code 604.502; or maintenance of treatment
facilities capable of providing water "assuredly adequate in quantity" as required by Section 18 of the Illinois
Environmental Protection Act.
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for
certain limited situations, or unless the supply has been granted a variance from the Illinois Pollution Control Board
for the violation, or from permit issuance requirements of Section 39 of the Act.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to
the status of any public water supply should be directed to the Division of Public Water Supplies for final
determination. This list reflects the status as of October 1, 2003.

Critical Review List -- Public Water Supplies
The Critical Review List was developed to give additional notification to officials of public water supplies which
may be close to being in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois
Environmental Protection Act.
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the
violations which would place it on the Restricted Status List.
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to
the status of any public water supply should be directed to the Division of Public Water Supplies for final
determination. This list reflects the status as of October 1, 2003.
