ORDER OF THE BOARD (by N.J. Melas):
Hearing in this matter is presently scheduled for December 23, 2003. On November 5,
2003, Stone, Pogrund & Korey, attorneys for Economy Plating, Inc. (Economy Plating),
petitioned the Board for leave to withdraw as counsel for Economy Plating. Stone, Pogrund &
Korey alleges that the Office of the Attorney General, on behalf of the People of the State of
Illinois (People), and Economy Plating have reached irreconcilable differences that “have
inhibited their legal relationship.” Neither the People nor Economy Plating has responded to the
petition.
Section 101.400(b) of the Board’s procedural rules requires only that counsel who wishes
to withdraw from representation must file a notice of withdrawal with the Clerk of the Board,
together with proof of service and notice of filing on all parties or their representatives. 35 Ill.
Adm. Code 101.400(b). The Board finds that Stone, Pogrund & Korey has satisfied this
requirement and grants the petition for leave to withdraw. The Board notes that corporations
must be represented by an attorney, and failure by Economy Plating to appear at hearing through
an attorney would constitute a default.
