    ORDER OF THE BOARD (by T.E. Johnson):
     
    On November 21, 2002, at the parties’ request, the Board extended until February 10,
    2003, the time period for Campton Township Highway Department to appeal an October 8, 2002
    determination of the Illinois Environmental Protection Agency (Agency).

    5/40(a)(1) (2002); 35 Ill. Adm. Code 101.300(b), 105.402, 105.406. At issue is the Agency’s
    rejection of the petitioner’s proposed budget for the site classification work plan regarding
    Campton Township Highway Department’s Underground Storage Tank site at 05N790 Route 47,
    in Maple Park, Kane County. Because petitioner failed to timely file an appeal, the Board
    dismisses this case and closes the docket.
