    TO EXTEND TIME FOR RESPONDENTS TO ANSWER
    Petitioner, the City ofChicago (“City”), by its attorney, Mara
    S.
    Georges, Corporation
    Counsel, by this motion requests that the hearing officer extend the time for the respondents in
    this action to answerthe City’s
    complaint, pursuant to
    35
    Ill. Adm.
    Code 101.522.
    In support of
    its motion the City states:
    1.
    The respondents in this case were served with the complaint on September
    8,
    2003.
    Accordingly, under 35
    Ill.
    Adm.
    Code
    103.204(d), the time within which they may file
    answers to the complaint ends on November 7, 2003.
    2.
    The parties to this
    case and 2222
    Elston LLC
    v. Purex Industries, Inc., et al., PCB
    03-55,
    are in negotiation toward
    a global settlement of both cases,
    and hope to reach an
    agreement in the near future.
    3.
    If the cases
    are settled, any response to the City’s complaint by the respondents

    will be moot.
    It would thus be
    a needless expenditure ofresources by the respondents to prepare
    responses to the City’s complaint.
    The City believes that at present the respondents’
    resources
    are better directed towards concluding a settlement.
    4.
    To
    foster settlement ofthese cases, the City requests that the hearing officer enter
    an order pursuant to 35
    Ill. Adm. Code 101.522 extending the time within which the respondents
    may respond to the City’s complaint to
    and including December
    5,
    2003.
    5.
    No otherparty to this case opposes the requested relief.
