    ORDER OF THE BOARD (by M.E. Tristano):

     

     On September 2, 2003, the Illinois Environmental Protection Agency (Agency) filed a proposal for rulemaking pursuant to Sections 27 and 28 of the Environmental Protection Act (Act), 415 ILCS 5/27 and 28 (2002).

     

     The Agency states the proposed clean-up of existing regulation results from comments by industry. The proposal seeks only to correct typographical errors in the existing “special formula” in Section 214.184 used to determine sulfur dioxide emissions from stationary sources. The Agency states the proposal clarifies the existing formula for calculating sulfur dioxide emissions from stationary sources.

     

     The petition is accepted for hearing. Under the circumstances, this rulemaking proposal satisfies the content requirements of 35 Ill. Adm. Code 102.202. While the Agency has not provided a synopsis of testimony in its proposal, the Board finds it unnecessary here. But, the Board expects the Agency to attend hearing for the purposes of answering any questions interested persons may have. See 415 ILCS 4(f), (i) (2002).

     

     The Board directs the hearing officer assigned to proceed expeditiously under the rulemaking provisions of the Act (415 ILCS 5/27, 28 (2002)) and the Board’s procedural rules (35 Ill. Adm. Code 102).
