NARRATIVE
On December
5,
2000, Ireceived a complaint against Prior Oil Company in Wamac, Illinois.
The complainant alleged that Prior Oil Company was dumping oil well development waste in.a
hole behind the old incineratorbehind Prior’s shop. I contacted Alan Whitler for the Illinois
Department ofNatural Resources Office ofMines and Minerals. Mr. Whitler said he would meet
me at the site.

Mike Grant and I arrived at Prior Oil Company on December
5,
2000 about 10:30. No one was
present. We walked to the rear ofthe property. We observed an oil stained area about 100 feet
south ofthe rail road traóks. By the growth stage ofthe vegetation in this area, it appears that
this oil was dumped some time ago.
While walking back to the rear ofthe shop, we met with Mr. Whitlerand Mr. Charlie Price, also
from the IDNIR. Mr. Price had located an area where oil waste was being dumped. This area is a
pile
ofconcrete rubble covered by heavy vegetation and trees. I observed vehicle tracks leading
up to this dump site. I observed oil stained soil in front of two concrete slabs. I observed oily
waste between the concrete slabs. I obs~rvedoily waste in a low areain a pile ofrubble covered
by trees and vegetation. I observed a tanker truck parked next to Prior Oil Company’s office.
The vehicle’s licence number is Illinois
3359.
It appears that a hose was.used to drain oily waste
from. a vehicle through two slabs ofconcrete and into this low area among the vegetation and
trees. I could not determine how much oil had been dumped into this low area. Mr. Whitler,
estimated that about 3 barrels, 126 gallons, of oil field waste had been dumped. Mr. Prior owns
two water input wells for the proper disposal ofoil field waste. According to Mr. Whitler, John
Prior Oil Company let their oil field waste hauling permit from the IDNR expire. Therefore, it
is not legal forPrior Oil Company to haul oil field waste.

On the, northwest side ofthe property I observed a large pile ofsoil. This pile ofsoil contained
oil filters, oily material and an old gas BBQ grill. This appears to be the sojl that was removed
from the pit containing oil that the Agency observed during an August 22, 2000 inspection. On
August 31, 2000, the Agency observed the soil from the oil pit in a 20-yd3 roll-offbox. I did not
observe this roll-offbox during this inspection. It appears that some ofthe waste from the roll-
offbox has been redeposited upon the land.
On December 13, 2000, I spoke telephonically with John Shamo ofHopper Environmental.
Mr. Shamo is Mr. Prior’s environmental consultant. Mr. Shamo told me that the landfill would
not accept the Agency’s sample results because ofthe way the units were report by the
laboratory. He stated that the waste may need to be resampled.
