On June 4,1996, Chris Calmovsky received a complaint that Prior Oil was discharging tank bottoms
into an abandoned mine shaft which is located next to an incinerator at the facility. I contacted Mines
and Minerals to discuss the allegation aboutthe dumping since they have primary authority governing
oil, well production waste. I discussed this situation with Mr. Alan V/hitler, District Manager in the
Centralia Office. Mr. V/hitler explained that Prior Oil did not have the appropriate permits for any ofhis
vehicles to haul any type ofoil field waste. He also informed me that they also did not have any
disposal permits issued through his office. I informedhim ofthe alleged location ofthe old mine shaft.
He said he would try to verify it’s existence and the exact location. We scheduled to meet in Wamac at
10:00 a.m. on June 13, 1996.
On June 13, 1996, Mr. Cahnovsky and I met Mr. Whitler in Wamac and attempted to view the~areain
question. Mr. Whitlerhad confirmed the existence and location ofthe shaft. The shaft could not be
viewed without entering Prior Oil’s facility. Mr. Cahn~vskyand I then went to the facility to do a
complaint investigation. We were accompanied during the inspection by Mr. Juvenile Hixenbaugh, an
employee ofPrior Oil Co. We observed the old incinerator and confmned that it was not operable.
North of the incinerator was a pile ofscrap tires. We then observed a Prior Oil tanker truck parked just
north ofthe old incinerator. As I approached the truck, I observed a hose connected to the truck which
led down into what appeared to be an open mine shaft. The hose did not have any discharge at the time
of our inspection. The soil around this opening was stained black. When questioned, Mr. Hixenbaugh
statedthat “clean storm water” collected from the tank batteries was being pumped into’the old mine.
The tanker truck’s Illinois license plate number was 3359 MR.
In addition to the tanker truck and the pile oftires we also observed two open drums ofwhat appeared to
be oil. A considerable amount of stained soil was also observed in the area ofthese drums. Photographs
ofthese areas were taken.
We then drove to Mr. Whitlers’ office and informed him of our findings. He told us that storm water
collected from tank batteries could not be disposed in this matter. Since these wastes are from crude oil
production activities, this material is a solid waste, however it is excluded from being classified as’a
hazardous waste pursuant to 721.1
