That Tulley Robinson is the present owner and operator of a facility located at 840
Berryville Road, Jonesboro, Union County,
Illinois.
The property is commonlyknown
to the Illinois
Environmental Protection Agency as Jonesboro/Robinson,Tulley Property.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating Permit and
is designated with
Site Code No.
1818565003.
3.
That Respondent has owned and operated said facility at all times pertinent hereto.
4.
That
on
July
23,
2003,
Doug
Hayward
of
the
Illinois
Environmental
Protection
Agency’s Marion
Regional Office inspected the above-described facility.
A copy of his inspection
report setting forth the results of said
inspection is attached hereto
and
made a part hereof.

VIOLATIONS
Based
upon direct observations
made by Doug
Hayward during the course of his July 23,
2003
inspection
of
the above-named
facility,
the
Illinois
Environmental
Protection
Agency
has
determined that
Respondent has violated the Illinois Environmental Protection Act (hereinafter, the
“Act”) as follows:
(1)
That
Respondent
caused
or
allowed
the
open
dumping
of
waste
in
a
manner
resulting
in
litter,
a
violation
of Section
21(p)(1) of
the Act, 415
ILCS 5/21(p)(l)
(2002).
CIVIL
PENALTY
Pursuant
to
Section 42(b)(4-5)
of the Act,
415
ILCS 5/42(b)(4-5)
(2002),
Respondent is
subject
to
a
civil
penalty
of
One Thousand
Five
Hundred
Dollars
($1,500.00) for
each
of
the
violations
identified
above,
for a
total
of
One
Thousand
Five
Hundred
Dollars
($1 ,500.00).
If
Respondent elects
not
to
petition the
Illinois
Pollution
Control
Board,
the statutory
civil penalty
specified above shall be due and payable no laterthan October 15, 2003, unless otherwise provided
by order of the Illinois Pollution
Control Board.
If Respondent elects to contest thisAdministrative Citation by petitioning the Illinois Pollution
Control Board
in accordance with Section 31.1
of theAct, 415
ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board

Affiant is a field inspector employed by the Land Pollution Control Division ofthe
Illinois Environmental Protection Agency and has been so employed at all times pertinent hereto.

On July 23, 2003, between
11:45 a.m. and
12:00 a.m., Affiant conducted an inspection
ofa disposal site operated without a permit, located in Union County, Illinois, and known as
Robinson, Tulley by the Illinois Environmental Protection Agency.

The purpose ofthis inspection
was to determine compliance with the Illinois Environmental Protection Act
and 35
Ill.

Waste Disposal Rules and Regulations ofthe Illinois Pollution
Control Board.
History:
This site was originally inspected on March 20, 2003 in response to
a complaint
alleging the open dumping of waste.
Upon inspection, this
inspector found
approximately 100 cubic yards (cy) of waste in two piles on the property.
One waste pile
was material dumped in
a pit
and the other was a pile
ofhousehold waste piled on the
ground next to the
drive.
The owner, Tulley Robinson was issued a violation notice, L-
2003-01094 dated April
3, 2003.
This inspector spoke with Mr. Robinson by phone after the violation notice was issued.
He indicated that he would remove and properly dispose of the material.
Inspection:
On this date, this inspector visited the site.
Mr. Tulley was not present and the inspector
identified himself to arid individual identifying herselfas his daughter.
I told her that
I
needed to
look at the waste piles and she indicated that I could do so.
The waste pile located in
the ditch does not appear to have changed since my first
inspection.
Weeds and brush have grown up and around the pile making access and
photographing difficult.
A couch can be identified in thephoto which was present during
the first inspection (photo 1).
The second waste pile appears to have been increased since the previous
inspection.
In
addition to a brush
pile,
cardboard, plastics and otherhousehold trash has been added
(photo 2).
