    ORDER OF THE BOARD (by T.E. Johnson):
     
    On May 1, 2003, at the parties’ request, the Board extended until July 29, 2003, the time
    period for Jack’s 66 Service Station to appeal a March 26, 2003 determination of the Illinois
    Environmental Protection Agency (Agency).

    415 ILCS 5/40(a)(1) (2002); 35 Ill. Adm. Code
    101.300(b), 105.402, 105.406. At issue is the Agency’s approval of the site classification work
    plan budget, with modifications, regarding Jack’s 66 Service Station’s underground storage tank
    site at 141 West Vandalia Road, Edwardsville, Madison County. Because petitioner failed to
    timely file an appeal, the Board dismisses this case and closes the docket.
     
    IT IS SO ORDERED.
