As I am sure many of you know, the Board’s Springfield Office has moved, and is
now housed separately, but in the same office space as the Illinois Environmental
Protection Agency. The Board’s new Springfield address is:

While we have a few minor aesthetic modifications to finalize, the move in
Springfield is essentially complete. I want to commend the Board’s Springfield,
Jacksonville and Urbana staff for their exceptionally hard work during this transition, and thank all Board
employees for their patience. The Board’s IT staff has been able to complete the move with a minimum of
inconvenience to the Board or the public, and the Board, as it has throughout the move, continues to function.
 
 
I want to emphasize that, although the Board is now located in the same building as the IEPA, we will continue to
function as an entirely independent entity. Aside from minor housekeeping duties that will be shared, the Board
will operate in the same manner we always have. All personnel and operational functions will remain, as before,
strictly Board business. The Board is cognizant of its status as an independent agency created in 1970 by the
Environmental Protection Act. Under the Act, the Board is responsible for adopting Illinois' environmental
regulations and deciding contested environmental cases
.
This would be impossible to do unless we maintain
complete substantive independence. I want to assure everybody that they can rely on the Board’s continued ability
to serve the citizens of the State of Illinois in completing its statutory duties.

Federal Update
 
United States Environmental Protection Agency Adopts a Ban on Trade of Methyl Bromide With Non-
Parties to the Montreal Protocol on Substances that Deplete the Ozone Layer
 
On July 25, 2003 (68 Fed. Reg. 43991), the United States Environmental Protection Agency (USEPA) adopted
direct final rules to ban the trade of methyl bromide with non-parties to the 1992 Copenhagen Amendments to the
Montreal Protocol on Substances that Deplete the Ozone Layer (Protocol). USEPA also proposed an identical rule.
If negative comments are received on the direct final rule, USEPA will withdraw and proceed to collect additional
comments on the proposed rule.
 
The direct final rule prohibits the import and exports of methyl bromide (class I, Group VI controlled substance)
from or to a foreign state that is not a Party to the Copenhagen Amendments to the Protocol in order to ensure the
United States meets its obligations under the Protocol and associated amendments.
 
Based on an analysis of the U.S. exports of methyl bromide to specific countries, USEPA has determined that only 3
countries of the 50 to whom U.S. producers of methyl bromide have exported over the past three years would be
impacted because they have not yet ratified the Copenhagen Amendments to the Protocol. Specifically, the rule
would ban the export of 41 metric tonnes to Cyprus, Cote d'Ivoire, and the United Arab Emriates compared to an
average export from the entire U.S. of 5,236 metric tonnes. These countries represent less than 1% of all U.S.
exports of methyl bromide for the years 2000, 2001, and 2002, so economic impacts for U.S. producers of methyl
bromide would be extremely minimal. The rule will not constrain U.S. farmers' ability to obtain methyl bromide
from importers because the major methyl bromide exporting countries have already ratified the Copenhagen
Amendments.

United States Environmental Protection Agency Adopts Amendments to the Rules for Identification and
Listing of Hazardous Waste and the Recycled Used Oil Management Standards Under the Resource
Conservation and Recovery Act
 
On July 30, 2003 (68 Fed. Reg. 44659), the United States Environmental Protection Agency (USEPA) adopted
amendments to the Hazardous Waste Management System regulations under the Resource Conservation and

Recovery Act (RCRA). The amendments correct drafting errors and ambiguities in the used oil management
standards.
 
Specifically, this rule clarifies 1) when used oil contaminated with polychlorinated biphenyls (PCBs) is regulated by
RCRA used oil management standards and when it is not, 2) that mixtures of conditionally exempt small quantity
generator waste and used oil are subject to RCRA used oil management standards irrespective of how that mixture
is to be recycled, and 3) that the initial marketer of used oil that meets the used oil fuel specification need only keep
a record of a shipment of used oil to the facility to which the initial marketer delivers the used oil.
 
This final rule will become effective on September 29, 2003.

United States Environmental Protection Agency Publishes Notice of Reconsideration of Clean Air Act Final
Rule; Request for Public Comment; Notice of Public Hearing in the Prevention of Significant Deterioration
(PSD) and Non-Attainment New Source Review (NSR) Regulations
 
On July 30, 2003 (68 Fed. Reg. 44620), the United States Environmental Protection Agency (USEPA) published a
notice of reconsideration of a final rule; request for public comment; notice of public hearing for its recent adopted
amendments to the Clean Air Act (CAA) New Source Review (NSR) program regulations.
 
The final rules were adopted by USEPA on December 31, 2002 and March 10, 2003, and govern the major NSR
programs mandated by parts C and D of title I of the CAA. Following these actions, the Administrator of USEPA
received a number of petitions for reconsideration. As a result, the USEPA announced that it will reconsider certain
issues arising from the final rules of December 31, 2002. The issues that will be covered include: 1) analysis of the
environmental impact of the final rule, 2) Plantwide Applicability Limitations (PALs), 3) Actual-to-Projected-
Actual Test, and 4) designation of Clean Unit status. USEPA will not respond to any comments addressing any
other provisions of the NSR rules or program.

United States Environmental Protection Agency Proposes Amendments to the Accidental Release Prevention
Requirements Under the Clean Air Act
 
On July 31, 2003 (68 Fed. Reg. 45123), the United States Environmental Protection Agency (USEPA) proposed
amendments to the accidental release prevention requirements for the Clean Air Act (CAA) submission schedule
and data regulations.

The data submission amendments address requirements for the risk management plan (RMP) regulation mandated
under the accidental release prevention provisions. These regulations require owners and operators of stationary
sources to submit RMPs to be made available to federal, state and local emergency planning and response agencies
and to the public through a central location. The first submissions were received in early 1999.
 
USEPA is now proposing to modify the RMP re-submission schedule for sources who have significant accidents
and for those who change the information for the emergency contacts. USEPA is also proposing to 1) add three
data elements to the RMP, 2) make several revisions to the submission format for the RMP, and 3) remove the
regulatory requirement to discuss the off-site consequence analysis in the RMP executive summary. USEPA
intends to issue a final rule addressing all of these proposed changes in time for the majority of facilities to complete
their 5-year anniversary re-submissions by June 21, 2004. The modifications proposed seek to improve the accident
prevention and reporting programs of regulated sources, and to assist federal, state, and local RMP implementation
in light of new homeland security concerns.

Board Adopts First Notice Opinion and Order in Noise Rule Update: Amendments to 35 Ill. Adm. Code 901
(R03-09)
 
On July 10, 2003, the Board adopted a first notice opinion and order in Noise Rule Update: Amendments to 35 Ill.
Adm. Code 901 (R03-09). The rulemaking proposal was sent to the Secretary of State for publication in the July
25, 2003 issue of the
Illinois Register
(27 Ill. Reg. 11908 and 11989).
 
The Board itself opened this rulemaking to propose updated regulations governing noise found in 35 Ill. Adm. Code
Subtitle H. Many of the sound measurement definitions and techniques in the Board’s current rules do not reflect
present scientific standards. The Board’s proposal will update the definitions and sound measurement techniques to
reflect current standards.
 
More specifically, the proposal revises outdated numerical sound emission standards for property line noise sources
found at 35 Ill. Adm. Code Parts 901. In Part 901, the Board proposes to replace the references to the Standard
Land Use Coding System codes with the more appropriate Land-Use Based Classification System. In addition, the
proposal adds new Part 910 to the Board’s rules to incorporates noise measurement techniques currently contained
only in Illinois Environmental Protection Agency rules at 35 Ill. Adm. Code 951.
 
This rulemaking is closely associated with the rulemaking Noise Rule Update Amendments to 35 Ill. Adm. Code
900 and 903, (R03-8), currently at second notice, that defines acoustical terms, pollution sources and sound
measurement procedures. R03-8 is also based on updated science, including pertinent American National Standards
Institute updates from 1998-2001, and other current scientific publications. See Noise Rule Update Amendments to
35 Ill. Adm. Code 900 and 903, R03-08 (April 3, 2003).

Board Adopts Proposal for Public Comment in SDWA Update, USEPA Amendments (July 1, 2003 through
December 31, 2003) (R03-15)
 
On July 10, 2003, the Board adopted a proposal for public comment in SDWA Update, USEPA Amendments (July
1, 2003 through December 31, 2003) (R03-15). The rulemaking proposes amendments to the Illinois regulations
that are “identical in substance” to drinking water regulations adopted by the United States Environmental
Protection Agency (USEPA). The USEPA rules implement Sections 1412(b), 1414(c), 1417(a), and 1445(a) of the
federal Safe Drinking Water Act (SDWA) (42 U.S.C. §§ 300g-1(a), 300g-3(c), 300g-6(a), and 300j-4(a) (1994)).
 
This docket includes federal SDWA amendments that USEPA adopted in the period July 1, 2002 through December
31, 2002. The rulemaking proposal was sent to the Secretary of State for publication in the July 25, 2003 issue of
the
Illinois Register

l. Reg. 11389).
 
As explained below, the substantive amendments involved in this proceeding update the analytical methods
approved for determining contaminants in drinking water and make minor changes to the consumer confidence
report rule.
 
Analytical Methods Update. On October 23, 2002 (67 Fed. Reg. 65220), USEPA amended the methods for analysis
of contaminants in water and wastewater. This included analytical methods used for determining compliance with
the SDWA drinking water requirements. The methods are used to determine chemical, microbiological, and
radiological contamination of water. USEPA noted that a number of entities updated their published methods:
ASTM International, the United States Geological Survey, the United States Department of Energy, the American
Public Health Association, the American Water Works Association, and the Water Environment Federation. In
updating the references to the various methods, USEPA stated that previously approved versions of the methods are
still available for use.
 
On October 29, 2002, USEPA approved two new methods for analysis of drinking water for various SOC
contaminants. USEPA published a correction to the October 29, 2002 notice on November 13, 2002 (67 Fed. Reg.
68911). Persons interested in the details of the federal amendments should consult the

The Board incorporated the October 23, 2002 and October 29, 2002 federal amendments into the Illinois drinking
water regulations by revision of the various references to the methods, where necessary, and by updating the
incorporations of the methods by reference.
 
Consumer Confidence Rule Changes. On November 27, 2002 (67 Fed. Reg. 70850), USEPA amended aspects of
the health effects language for the consumer confidence rule. The principal amendments relate to two chemicals,
di(2-ethylhexyl)adipate and di(2-ethylhexyl)phthalate. Other amendments are called minor corrections by USEPA.
USEPA published a minor correction to the November 27, 2002 action on December 9, 2002 (67 Fed. Reg. 73011).

On July 24, 2003, the Board adopted a first notice opinion and order in Site-Specific Rule for City of Effingham
Treatment Plant Fluoride Discharge, 35 Ill. Adm. Code 304.233 (R03-11). The rulemaking proposal was filed with
the Secretary of State’s Index Department and will be published in the
Illinois Register
on August 15, 2003.

This rulemaking was initiated by a proposal filed by the City of Effingham (City), Blue Beacon International, Inc.
(BBI) and Truckomat Corporation (Truckomat) to add Section 303.326 as a site-specific water quality designation.
 
The proposed amendments would add a new Section 303.326 setting a site-specific fluoride water quality standard
of 5.0 mg/L to accommodate the discharge of fluoride from the City’s publicly owned treatment works (POTW).
This level of fluoride is gradually reduced downstream from the POTW to 3.2 mg/L and then 2.0 mg/L before it
reverts back to the general water quality standard of 1.4 mg/L.
 
BBI and Truckomat operate truck washes in Effingham, and the wastewater from the truck washes contains fluoride
resulting from the brighteners used in washing the trucks. Both companies have testified at hearing that there are no
alternative replacements for these brighteners, and that discontinuing their use would cause a severe negative
economic impact for both the facilities and for the surrounding businesses that rely on the truck traffic generated by
the washing facilities.
 
The proposal filed by the City, BBI, and Truckomat originally sought relief from the Board’s effluent standards at
35 Ill. Adm. Code 304. While the Illinois Environmental Protection Agency (IEPA) testified at hearing that the
requested relief from the fluoride rules will continue to be protective of the waters of the state located downstream
from the POTW, the IEPA stated that the petitioners should have requested relief from the fluoride water quality
standard, rather than the effluent standard. The IEPA explained that site-specific relief from the effluent standards
could still leave the City open to the possibility of a violation of the water quality standards and could be
inconsistent with federal law. The IEPA suggested that the Board could be viewed as essentially granting a
discharger indefinite or permanent permission to violate a water quality standard. The IEPA suggested that the
Board instead establish a site-specific water quality standard for the receiving waters of the POTW. Consequently,
the Board’s proposed rule is a site-specific water quality standard.
 
A hearing was held in Effingham on April 11, 2003 on the substance of the rulemaking. On July 18, 2003, the
Board held a second hearing dealing solely with the Illinois Department of Commerce and Economic Opportunity’s
decision not to conduct an economic impact study on this proposal.

Commodities – The Board entered a final order finding respondent liable for civil
penalties in the amount of $15,000 and ordered respondent to implement
operational noise reduction measures to eliminate the unreasonable interference.
This order follows the Board's interim order of February 15, 2001, which found
that respondent violated the nuisance noise provisions of the Environmental
Protection Act and the Board’s regulations found at 415 ILCS 5/24 (2002) and
35 Ill. Adm. Code 900.102 at a site located at the northeast corner of the
Interstate 94 tollway and Route 22 at 2800 North Lakeside Drive in
Bannockburn, Lake County.

are in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental
Protection Act.
 
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a
violation of any of the following requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604,
Subparts B and C; maintenance of adequate pressure on all parts of the distribution system under all conditions of
demand; meeting raw water quantity requirements of 35 Ill. Adm. Code 604.502; or maintenance of treatment
facilities capable of providing water "assuredly adequate in quantity" as required by Section 18 of the Illinois
Environmental Protection Act.
 
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for
certain limited situations, or unless the supply has been granted a variance from the Illinois Pollution Control Board
for the violation, or from permit issuance requirements of Section 39 of the Act.
 
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to
the status of any public water supply should be directed to the Division of Public Water Supplies for final
determination. This list reflects the status as of July 1, 2003.
