Good morning. My name is Carol Sudman. I

am a hearing officer with the Pollution Control Board.

This is PCB 03-87, Main Station versus IEPA. It is July
6
4th (sic) at 12:10.

MR. KIM: July 4th?
8
HEARING OFFICER SUDMAN: July 24th. Excuse
9
me. Thank you.

This hearing is continued from July 21st,
11
and as noticed, is being held after another docket was
12
heard this morning.
13
The parties have, since I have spoken to
14
them last, informed me that they expect to settle this
15
matter, and they have requested cancellation of this
16
hearing.
17
Would either of the parties like to make
18
any further elaboration on the record?
19
Mr. Martin, do you have any further
20
comments?

MR. MARTIN: I don't think so at this
22
time. We anticipate -- maybe I would. Notice I'm
23
starting into it. It's lunchtime.

We anticipate another decision letter out

by next week from the agency that may very well resolve
2
the issues that are pending now. And if it is, if it
3
turns out to be what we believe it will be, then we will
4
be dismissing the case. If it is not, then I suppose we
5
will be notifying you to get it back on track for
6
hearing.

HEARING OFFICER SUDMAN: Okay. Mr. Kim,
8
would you like to add anything further?

MR. KIM: No, other than Mr. Martin's
10
statements are consistent with what the agency's
11
position is. And we also believe that the letter that's
12
soon to be issued will resolve the outstanding issues,
13
that this matter can hopefully be dismissed.
14
HEARING OFFICER SUDMAN: Great. Well, at
15
this time, I will conclude these proceedings, and we
16
will stand adjourned on Main Station.
