In support ofthis motion, the Illinois EPA states as follows:

The Petitioner, DaLee
Oil
Company, filed its
appeal
on or about May 8,
2003.
The Illinois
EPA received notice of the Petitioner’s
filing
on May 9,
2003.
Pursuant
to
35
Iii.
Adm.
Code
105.116, the Administrative Record (“record”)
is
to be filed with the Board
within
thirty
(30) days after the
filing ofthe petition.
Accordingly, the record was due to be
filed on or
before June 7, 2003.
That date was a Saturday, and the following business day was June 9, 2003.

This
appeal
is
linked
to
a
number
of
other
appeals
involving
a
common
environmental consultant retained by the respective owners or operators that have filed petitions.
3.
The
Petitioner
and
the
Illinois
EPA
have
been
in
discussions
regarding
the
resolution ofthis and all other related actions.
Further, the parties have been in contact with the
Hearing Officer assigned by the Board.
4.
Following
extensive
discussions
between the parties,
the
progress of which has
been consistently and periodically provided to the Hearing Officer, the parties have agreed that a

number of other related appeals can be considered as either
settled or not in need ofa hearing at
this time.
Specifically, of 10 appeals involving the common consultant originally set for hearing
in July, six have since been either resolved or will be stayed pending further efforts to resolve the
underlying issues.
5.
The time
spent negotiating the resolution ofthese appeals has delayed submission
ofthe Administrative
Record, although the end results were certainly worth the effort expended.
The
Illinois
EPA nonetheless regrets the delay,
and
hopes that
the
Board will accept this
late
filing.
WHEREFORE,
for
the
reasons
stated
above,
the
Illinois
EPA
hereby
respectfully
requests that the Board grant the Illinois EPA leave to file instanter the Administrative Record.

from the Illinois Underground Storage Tank Fund for the above-referenced facility.

The amount requested
was $20,999.77.
The deductible amount for this claim is $15,000.00,
which was previously deducted from the
Invoice Voucher dated January
3,
1997.
Listed in
Attachment A are the costs which are not
being reimbursed from this request and
the reasons these costs are not being reimbursed.
On November 27,
2001, the Agency received your complete request for payment for this claim.
As
a result of the Agency’s review ofthis claim, a voucher for $16,428.73 will be prepared for
submission to
the Comptroller’s Office for payment as funds become available based upon the
date the Agency received your complete request for payment ofthis claim.
Subsequent claims
that have beenlare submitted will be processed based upon the date complete subsequent billings

The groundwater
treatment system is routinely cleaned and maintained twice a month to ensure
proper remediation of the
groundwater
entering the
system.
If maintenance
is
not
performed
more than once a month, the system becomes clogged due to the presence ofcontaminants on the
air
stripper trays.
At the beginning of each month,
the
effluent
samples
are collected
and
the
system
is cleaned.
The
system
is againcleaned during the middle ofthe month.
During
routine
maintenance,
a
problem with
one
the
recovery
well
pumps
was
discovered.
Several
attempts
were
made to
remove the
pump
from
the well.
However, as
a
result of silt
passing through
the
filter
pack
and
screen,
the
pump
is
stuck
in
the
well
and
all
attempts
to
remove
it
have thus
far be~unsuccessfu1.
