FACTS

That Sharyn Fuller is the present ownerand Carl Benedict is the operator(collectively
“Respondents”) of a facility located on the southwest side of the intersection of Pottstown Road and
Kickapoo
Creek
Road,
Kickapoo
Township,
Peoria
County,
Illinois.
The
property is commonly
known to
the Illinois Environmental Protection
Agency as Fuller, Sharyn.
2.
That
said
facility
is
an
open
dump
operating
without
an
Illinois
Environmental
Protection Agency Operating Permit and is designated with
Site Code No. 1438075011.
3.
That Respondents have owned and operated said facilfty~atafl:th~esp~rtinentheieto.
4.
That
on
March
31,
2003,
Gene
Figge
of
the
Illinois
Environmental
Protection~
Agency’s Peoria
Regional Office inspected
the above-described facility.
A copy of his inspection
report setting forth the results of said inspection
is attached hereto and
made a part hereof.

VIOLATIONS
Based
upon direct observations made
by Gene
Figge during the course
of his March
31,
2003
inspection
of
the
above-named
facility,
the
Illinois
Environmental
Protection
Agency
has
determined that
Respondents have violated the Illinois Environmental Protection Act (hereinafter,
the
“AcV’) as follows:
(1)
That
Respondents
caused or allowed the open
dumping
of waste
in
a
manner
resulting
in
litter,
a
violation
of Section
21(p)(1) of the
Act, 415
ILCS
5/21(p)(1)
(2002).
CIVIL PENALTY
Pursuant to Section
42(b)(4-5) of the Act, 415 ILCS 5/42(b)(4-5) (2002),
Respondents are
subject
to
a
civil
penalty of
One
Thousand
Five
Hundred
Dollars
($1,500.00) for
each
of
the
violations
identified
above,
for
a total of
One Thousand
Five
Hundred
Dollars
($1,500.00).
If
Respondents
elect
not
to
petition
the Illinois
Pollution
Control
Board,
the
statutory civil
penalty
specified above shall be due and payable no later than June
15, 2003, unless otherwise provided by
order of the Illinois
Pollution Control Board.
IfRespondents elect to contestthis Administrative Citation by petitioning the
Illinois Pollution
Control Board in accordance with
Section 31.1
of theAct, 415 ILCS 5/31.1(2002), and if the Illinois
Pollution Control Board issues a finding of
violation as alleged herein, after an adjudicatory hearing,
Respondents shall be assessed the associated hearingcosts incurred bythe Illinois Environmental
Protection Agency and the Illinois Pollution Control Board.
Those hearing costs shall be assessed
in
addition
to
the One Thousand
Five
Hundred Dollar ($1 ,5Q0.00) statutory civil penalty for each
violation.

Affiant conducted an inspection of the open dump in Peoria
County,
Illinois, known as Fuller,
Sharyn,
Illinois Environmental

Affiant inspected said Fuller,
Sharyn open dump site by
an on-site inspection, which included walking and photographing
the site.

As a result of the activities referred to in

NARRATIVE
On March 31, 2003, a reinspection was
conducted
from
9:30
a.m. until
9:50
a.m. at Fuller,
Sharyn by R. Eugene Figge
(this author) ofDLPC/FOS
-
Peoria. The used tire notification form
has not been submitted. The annual fee has not been paid. In a telephone conversation Carl
Benedict stated that he would remove the rest ofthe tires from the site by the end of March.
On the site it was observed that approximately 200
used tires remained. These tires were located
in an over grown areatoward the rear of the property as shown in photographs 9 through
13.
Some ofthe used tires had been moved to the front of the property for ease of access as shown in
photographs
1
through 4. There were also several accumulations of general refuse as shown in
photographs
5
and 6. Various old vehicles were also located around the property. The property is
located between Kickapoo Creek and the railroad tracks in Pottstown.
The following apparent violations were indicated on the inspection checklist:
