ORDER OF THE BOARD
(by Mr. Goodman):
On June
3,
1976,
the Board entered an Order herein requiring
Vermillion Tile Company, Incorporated to amend their petition to
include their program and time schedule for achieving compliance.
The last sentence of the said Board Order said “failure
to timely
file the amended petition shall render the cause liable
to dis-
missal.”
It has now been over 90 days since the June
3, 1976 Order
of the Board and upon the August
9,
1976 Environmental Protection
Agency Motion to Dismiss, the Board hereby dismisses the variance
petition herein
as insufficient.
