County pursuant to 415 ILCS 5/4 (r).
Facts
1.
That Respondent Rochelle Waste Disposal, LLC, is the present operator of a
facility located at 6513 S.
Mulford
Road,
Rochelle,
in the County of Ogle,
State of
Illinois.
2.
That Respondent, Clyde A.
Gelderloos,
is the Chief Operator ofthe above
referenced facility.
3.
That Respondent, City of Rochelle,
is the permitted owner of said facility.
4.
That said facility,
Rochelle Municipal Landfill #2,
is operated as a sanitary landfill,
operating under Illinois Environmental Protection Agency Operating
Permit
No.
I 994-547-LFM, and designated with
Site
Code No.
1418030020.
5.
That
Respondents
have owned or operated said facility at all times
pertinent
hereto.
6.
That on March
19, 2003, at 5:10 p.m.
a complaint was received
by voice mail at
the Ogle County solid Waste Management Department (OCSWMD), from
a
concerned citizen stating that there was blown litter outside of the facility and all
along the southwestern corner of the site.
7.
That on March
20,
2003, Stephen J.
Rypkema, of the Ogle County Solid Waste
Management Department, inspected the above-described
landfill facility.
A copy
of the inspection report setting forth the results of such inspection is attached
hereto and made a part hereOf.
Violations
On the
basis of direct observation by Stephen J.
Rypkema, the County of Ogle
has determined that Respondents were conducting a sanitary landfill operation at the
above-described facility, which is required to have
a permit pursuant to 415 ILCS 5/21(d)
(2000),
in
a manner which resulted in the following violations:
A.
That on March
20,
2003 an on-site inspection of said sanitary landfill
facility, and review of Illinois
Environmental
Protection Agency files
and
records of said facility, disclosed the following:
1.
Refuse in
standing or flowing water,
in violation of 415 ILCS
5/21 (o)(1) (2000).
2.
Uncovered refuse remaining from
a previous operating day,
in
violation of 415 ILCS 5/21 (o)(5) (2000).
3.
Failure to collect and contain litter from the site by the end of each
operating day,
in violation of 415 ILCS 5/21(o)(12) (2000).
Civil Penalty
Pursuant to 415 ILCS 5/42(b)(4) (2000)., Respondents
herein
are subject to a
civil penalty of Five Hundred Dollars ($500.00) for each violation specified above
in

Paragraph A, for a total of one thousand five hundred Dollars ($1500.00).
Additionally,
should
Respondents elect to petition
the Illinois Pollution Control
Board under the review
process described herein below, and if there is a finding of the violations alleged
herein,
after an adjudicatory hearing,
Respondents shall be assessed the associated hearing
costs incurred by Ogle County and the Illinois Pollution Control
Board,
in addition to the
Five Hundred Dollar ($500.00) statutory penalty for each finding of violation.
If Respondents acknowledge the violations cited herein above, the civil penalty
specified above shall be due and payable no later than ~

If Respondents do
not petition the
Illinois Pollution Control Board for review of this Administrative Citation
within thirty-five (35) days of service hereof or
if Respondents elect to contest this
Administrative Citation,
any judgment rendered against
Respondents shall specify the
due date of the statutory civil penalty and any costs assessed
against Respondents.
When payment is made, Respondents check should be made payable to Ogle
County Solid Waste Fund and mailed to the Ogle County Treasurer, Ogle County
Courthouse, Oregon, IL 61061.
Respondents shall complete and return the enclosed
Remittance Form to ensure proper documentation of payment.
If any civil penalty, by reason of acknowledgment, default or finding after
adjudicatory hearing, is not paid when
due, the Illinois Environmental Protection Agency
shall take into consideration such failure to pay during any permit review process
upon
Respondents application for a new permit or for renewal of an existing permit.
If any
civil
penalty imposed by the
Illinois Pollution Control
Board is not paid within the time
prescribed in
the order, interest on such penalty will be assessed for the period
from
the
date payment is due until the date payment is received.
Furthermore,
if payment is not
received when due, the
Ogle County State’s Attorney shall be requested to initiate

proceedings in Circuit Court to collect said civil penalty.
In addition to the previously
assessed
civU penalty, interest, and hearing costs of Ogle County and the Illinois
Pollution Control Board, if any, the Ogle County State’s Attorney will seek to recover
their costs of litigation.
Procedure for Contesting this Administrative Citation
Respondents have the right to contest this Administrative Citation, pursuant to
and
in accordance with 415 ILCS 5/31.1(2000).
If Respondents elect to contest this
Administrative Citation,
Respondents must file a Petition for Review with the Clerk of the
Illinois Pollution Control Board.
A copy
of the Petition for Review should be filed with the
Ogle County State’s Attorney.
Such Petition for Review must be filed within thirty-five
(35) days of the date of service of this Administrative Citation, or a default judgment
shall be entered by the Pollution Control Board.

Board at the State of Illinois Center,

Affiant is a Director and field inspector employed by the County ofOgle
andhas
beenso employed at
all times pertinent hereto.
2.
On March 20, 2003 between 10:04 a.m.
and
11:21
a.m., Affiant conducted an inspection of the
sanitary landfill locatedin Ogle County, Illinois
and known as Rochelle Municipal Landfill #2.
Illinois Environmental Protection Agency Site No.1418030020 (operating under the IEPA Permit
No. 1994-547-LFM, Modification #28).
3.
Affiant inspected said Rochelle Municipal Landfill #2 site by an on-site inspection which included
walking
and
photographing the site, interviewing personnel (and reviewingIllinois
Environmental
Protection Agency permits issued to the subject site).
4.
As a result of the activities referred to in Paragraph 3
above, Affiant completed the Inspection
Checklist form attached hereto and made a part hereof,
which,to the best of Affiant’s knowledge and
belief, is an accurate representationof Affiant’s observations andfactual conclusions withrespect to
said Rochelle Municipal Landfill #2 site.

General Remarks
A complaint was received a little after
5
p.m. on3/19/03 byvoice mail from aconcerned citizen
reporting there was blown litter outside
the site
and
all alongthe southwesterncornerofthe
Rochelle
Municipal #2 Landfill.
I arrived
at
about
10:04
a.m
on
March
20, 2003.1
drove
to the
southwest
cornerofthe site
and parked
at the leachate
storage area.
Thewhole southeastern
corner
ofthe sitehad
quite a
lot
ofblown litter, as
well as
along
the ditch
and drainage
way that
exits the site underneathMulford
Road.
Some ofitwas in thebushes
and trees.
It extended
fromtheSWcorner
eastward over to where therewere three movable litter fences, which
were
full oflitter. From there, the litter was scattered over to the working area.
All ofit appeared to be
from the previous day.
Two people
were
collecting litter and
therewere probably
15-20
bags
full oflitterby the time I
arrived there.
The winds,upon
arrival,
were
light from the SE, although
it
was very foggy and
calm earlierthat morning as reported
bythe NationalWeather
Service in
Rockford. Theworking
facewas
northeast
ofthe littered area so itwas notpossible that theblown litter could have
accumulated
that
morning.
It
all
appeared tobe wetandto have
been
there since at
least
the
previous day, if not longer.
Across MulfordRoad to theSWofthe landfill, there was at least adozenpieces oflitter
scattered along the corn field, also along the ditchonMulfordRoad.
Approaching the landfill
from Mulford Road to the North, therewere probablyahalfa dozenpiecesofplasticblown into
the
farm
fieldsonboth sides ofMulfordRoad.
I leftthe area ofthe SWcornerofthe site.
I drove into the site
and
checked in atthe scale house.
The scale house operatorcontactedClyde Gelderloos, hewas at ameeting
and
unavailable. She
then contactedTom Hilbertwho saidhewould meetme in20 minutes. Ithenmet
with
Donovan
Delegauwho cameto the scalehouse andwedrove down to the working face.
I lethimknow
the litterat the SWcornerofthe site appeared tome to havebeenthere from the previous
operating day
and
was unacceptable. He admittedthe litter
was
badand saidthewinds were
strong the
previous
dayand theywere unableto get itpickedup. But they did have people
pickingupthe litter. He later mentioned that normally theyhave
two
guys pickingup litter, but
one
was
in court the previous day, sotheyonlyhadone plus himselfand the other equipment
operator.
We
walked
over to the
working
face
and
up to the top.
Itook alook at the
area
ofconcernfrom
the top. Obviously there
was waste
that
was
uncovered onthe south
bank
of
Phase
I of
Unit II
and
the litter fenceswere still scattered
with
litterfrom the previousday ormore. The waste
was
scattered
all
theway to theSWcorner ofthe sitewhere the litter pickers werepicking it up.
Conditions werewetthat day. Donovanmentionedthey were unable to get the litter fences
moved towhere theywould bemore effective, because ofthe wet conditions ofthe soil.
I
suggested theyuse cables orfmdsome otherwayto drag the fenceswhere they
can
bemore
effective.
I also suggested they
install
secondaryfencing aroundthe perimeter ofthe site or
hire
additional laborers topickupthe litterprior to the endofthe operating day. Heagreed these
were good ideas but said he is limited as towhat he
can
do at the site.
Donovan
and
I droveback to the scale house andTom Hubert arrived. Donovan left, Tomand I
drove overto theSW cornerwhere the leachate storage tank is.Welooked at the area ofconcern,
Iexpressedmyconcern that the litter
had
not been pickedup. Headmittedhehadbeen there
yesterday afternoon
and
that he
did
notice the litter inthat
area.
We talkedabout the fact that the
waste was
uncovered.
There was
somedisagreement aboutwhat is “uncovered waste”.
Imentioned toTom that I wouldbe
writingthis
inspection
report
up and discussing it
with our
enforcement decisiongroup
and
making a decision. Further actionwould probablybewarranted
bythese apparent violations.
