ORDER OF THE BOARD (by G.T. Girard, C.A. Manning, J. Yi):
By hearing officer order dated July 30, 1997, the record in this matter was scheduled to
close on September 4, 1997, with various motions, responses, and comments due to be filed
on various dates no later than September 4, 1997. Now pending before the Board in this
docket are various motions for leave to file comments instanter, as well as motions to file
language changes to the proposal, to supplement the record, and to establish a new subdocket.

The motions for leave to file comments, to supplement the record, and to accept language
changes are hereby granted. Ruling is reserved on the motions to establish a subdocket.
The hearing officer’s order closing the record on September 4, 1997, was based on the
target dates established in the Board’s order of May 15, 1997, responding to the Agency’s
motion to expedite completion of this rulemaking. One of these target dates was the entry of a
second notice order on September 18, 1997. This would have allowed the Board 10 working
days following the close of the record to review comments and draft an order. As the last of
the comments from the proponent and other major participants were not received until
September 12, 1997, the Board has been unable to adhere to its projected schedule. The Board
continues to review the record and comments; a second notice order will be adopted as
expeditiously as possible.

The pending motions include; 1) a the September 2, 1997 motion of the Illinois
Environmental Protection Agency (Agency) to accept its filing of language changes and to
supplement the record; 2) a September 4, 1997 motion of the Illinois Environmental
Regulatory Group (IERG) to establish a subdocket and to supplement the record; 3) a
September 4, 1997 motion of the Department of the Navy (Navy) for extension of time to file
comments; 4) a September 10, 1997 motion by the Agency to file post-hearing comments; 5) a
September 1, 1997 motion by the Navy to withdraw its September 4, 1997 motion and for
leave to file comments instanter; 6) a September 11, 1997 motion by the Office of the
Attorney General for leave to file comments instanter; 7) a September 12, 1997 motion by
Lake Michigan Federation and Sierra Club for leave to file comments instanter; and 8) a
September 12, 1997 Agency response to IERG’s September 4, 1997 motion to establish
subdocket.
