Letter from the Chairman
 
 
 
April 22 marked the thirty-third celebration of Earth Day. The Board is also
celebrating its thirty-third year. The Board recognizes the tradition of Earth Day as
a strong part of our State’s public commitment to protect the Earth for generations
to come. In Illinois, the Board has always been linked with Earth Day. Both were
created in 1970, and share a common purpose. Earth Day was created primarily as
a symbol of our nation’s commitment to the environment. The Board’s creation
and authority is found in Illinois’ Environmental Protection Act, the stated purpose
of which is to establish a unified, state-wide program to restore, protect and
enhance the quality of the environment.
 
Earth Day and the Board have each been extremely successful in fulfilling their original purpose. Thirty-three years
have passed, but each remains vital in its own way. Earth Day continues to raise the consciousness of the public
regarding important environmental issues. The Board continues to determine, define and implement the
environmental standards applicable to the State of Illinois. Although Earth Day comes but once a year, we at the
Board fulfill our statutory duty on a daily basis. Currently the Board has approximately 300 pending adjudicatory
cases and rulemakings. As you know, the Board must make all of its decisions in writing, after votes are taken at
open meetings. In the last eighteen months, the Board has issued over 1,000 opinions and orders, after review of
lengthy briefs, hearing transcripts, and public comment.
 
At this time of the year, perhaps more than any other, residents of Illinois are actively enjoying the pleasures of our
State’s environment. The continued celebration of Earth Day, and the work of the Board and other environmental
state agencies are important factors in maintaining a healthy environment for all of us to enjoy. It is incumbent
upon all of us to do our part. I want to thank all those involved for their valuable contributions, and I am sure that,
working together, we will be able to enjoy a vital environment for years to come.

United States Environmental Protection Agency Proposes Revisions to the Wastewater Treatment
Exemptions for Hazardous Waste Mixtures Under the Resource Conservation and Recovery Act
 
On April 8, 2003 (68 Fed. Reg. 17233) the United States Environmental Protection Agency (USEPA) proposed
revisions to its wastewater treatment exemptions for hazardous waste mixtures (Headworks Exemptions).
 
USEPA proposed to add benzene and 2-ethoxyethanol to the list of solvents whose mixtures with wastewater are
exempted from the definition of hazardous waste under the Resource Conservation and Recovery Act (RCRA).
USEPA had studied two other solvents (1,1,2-trichloroethane and 2-nitropropane), but did not propose adding them
at this time to the exemption list.
 
Besides adding the two solvents to the exemption, USEPA also proposed to provide flexibility in the way it
determines compliance with the rule by adding the option of directly measuring solvent chemical levels at the
headworks of the wastewater treatment system. Finally, USEPA also proposed to make additional listed hazardous
wastes (beyond discarded commercial chemical products) eligible for the de minimis exemption, as well as adding
non-manufacturing facilities to those that qualify for this exemption if certain conditions are met.

United States Environmental Protection Agency Adopts National Emission Standards for Hazardous Air
Pollutants Under the Clean Air Act for Coke Ovens: Pushing, Quenching, and Battery Stacks
 
 
On April 14, 2003 (68 Fed. Reg. 18007) the United States Environmental Protection Agency adopted National
Emission Standards for Hazardous Air Pollutants (NESHAPs) for Coke Ovens: Pushing, Quenching, and Battery
Stacks.
 
USEPA’s final rule promulgates NESHAPs for coke ovens. The standards establish emission limitations and work
practice requirements for control of hazardous air pollutants (HAP) from pushing, quenching, and battery stacks at
new and existing coke oven batteries. The HAP emitted from pushing, quenching, and battery stacks include coke
oven emissions, as well as polycyclic organic matter and volatile organic compounds such as benzene and toluene.

Exposure to these substances has been demonstrated to cause chronic and acute health effects. These final
standards will implement section 112(d) of the Clean Air Act (CAA) by requiring all major sources to meet HAP
emission standards reflecting application of the maximum achievable control technology. USEPA has previously
promulgated emission standards addressing emissions from coke oven charging, topside leaks, and door leaks.
 
The adopted rule is effective April 14, 2003.

United States Department of Justice Publishes Notice of Consent Decree Under the Clean Air Act
 
On April 24, 2003 (68 Fed. Reg. 20171) the United States Department Of Justice published a notice that, under 218
CFR 50.7, a proposed Consent Decree was lodged with the United States District Court for the Central District of
Illinois in United States v. Archer Daniels Midland Company, Civil Action No. 03-2066.
 
The consent decree addresses claims against Archer Daniels Midland Company (ADM) for violations, at 52 plants
in 16 states including Illinois, of the Preventions of Significant Deterioration (PSD) and New Source Performance
Standards (NSPS) requirements of the Clean Air Act pursuant to section 113(b) of the Clean Air Act (CAA), 42
U.S.C. 7413(b) (1983), amended by, 42 U.S.C. 7413(b) (Supp. 1991). The complaint alleges that ADM routinely
underestimated its volatile organic compounds emissions from corn processing and ethanol production units and
modified and expanded its oilseed plants without obtaining appropriate pre-construction permits and installing air
pollution control equipment.
 
Under the terms of the consent decree, ADM will install state-of-the-art air pollution controls on hundreds of units,
shut down older, dirty units and accept restrictive emission limits on others, for a total emission reduction of 63,000
tons per year. In addition ADM will meet the NSPS, for boilers, grain elevators, coal loading operations, and
storage tanks. See 40 CFR 60, Subparts Db, Dc, DD, Kb, and VV. Finally, ADM is obligated to implement a
corporate-wide environmental management system and conduct multi-media audits of each of its facilities at least
twice over the life of the decree.
 
The injunctive relief package is expected to cost ADM $328 million over the ten-year period of compliance. ADM
will also pay a civil penalty of $4,604,000 ($2,505,600 paid to the United States and $2,098,400 paid to the states)
and spend $6,363,000 on environmentally beneficial projects. The states that have filed complaints-in-intervention
and executed the consent decree include Arkansas, Indiana, Illinois, Iowa, Kansas, Minnesota, Missouri, Nebraska,
North Dakota, South Carolina, and Texas, as well as the Iowa Counties of Linn and Polk and the Nebraska County
of Lancaster.
 
The Department of Justice will receive comments relating to the ADM consent decree for 30 days after the
publication of its notice (until May 24, 2003). Comments should be addressed to the Assistant Attorney General,

United States Department of Justice Publishes Notice of Lodging of Settlement Agreement Under the
Comprehensive Environmental Response, Compensation and Liability Act and Chapter 11 of the United
States Bankruptcy Code
 
On April 24, 2003 (68 Fed. Reg. 20172) the United States Department Of Justice published a notice that on April
11, 2003, a proposed settlement agreement (agreement) was lodged with the United States Bankruptcy Court for the
Northern District of Illinois, Eastern Division in In re Kmart Corp., et al., Case No. 02-02474.
 
The agreement is between Kmart Corporation and its affiliated debtors and debtors-in-possession (collectively, the
debtors) and the United States, on behalf of the United States Environmental Protection Agency (USEPA), the
United States Department of the Interior, and the National Oceanic and Atmospheric Administration of the United
States Department of Commerce. The agreement relates to liabilities of the debtors under the Comprehensive
Environmental Response, Compensation and Liability Act of 1980, as amended, 42 U.S.C. 9601
et seq
. Under the
agreement, the United States, on behalf of USEPA, would receive allowed secured claims totaling $579,151 for the
following five sites: the Lenz Oil Services site (DuPage County, Illinois); the Beede Waste Oil site (Plaistow, New
Hampshire); the Florida Petroleum Reprocessors site (Davie, Florida); the Hows Corner site (Plymouth, Maine);
and the Jack Goins site (Cleveland, Tennessee).
 
The agreement also addresses claims in South Carolina, Florida, Louisiana, California, and Washington and a right
to seek cost recovery in the future in connection with Operable Unit 2 of the Peterson Puritan site (Cumberland,
Rhode Island), with up to $506,500 of such cost recovery payable as an allowed secured claim and any amount over
that payable as an allowed unsecured claim.
 
The agreement further provides that for debtor-owned sites, environmental claims and actions by the United States
are not discharged. However, for the following nine sites, environmental claims by the United States are
discharged, to the extent the claims arise from the debtors' conduct before the bankruptcy action: the Adkins
Branch Tire Dump (Putnam County, West Virginia); the Bufkin Store Lead site (Tabor City, North Carolina); the
Chadbourn Battery site (Chadbourn, North Carolina); the Guyton Battery site (Chadbourn, North Carolina); the
Jimmy Green Metals site (Nashville, North Carolina); the Odum Bufkin Battery site (Green Sea, South Carolina);
the Old Stake Road Lead site (Chadbourn, North Carolina); the Petroleum Conservation site (a/k/a the U.S. Oil,
Two Rivers site) (Two Rivers, Wisconsin); and the Vinegar Hill Battery site (a/k/a the Williams store site) (Tabor
City, North Carolina). For all other sites, the United States may not issue or seek environmental orders based on the
debtors' conduct before the bankruptcy action, but may recover response costs and natural resource damages based
on such conduct, as if the United States' claims had been allowed unsecured claims under the debtors' reorganization
plan.
 
The Department of Justice will receive comments relating to the agreement for 30 days following the date of

United States Environmental Protection Agency Adopts National Emission Standards for Hazardous Air
Pollutants Under the Clean Air Actfor Asphalt Processing and Asphalt Roofing Manufacturing
 
On April 29, 2003 (68 Fed. Reg. 22975) the United States Environmental Protection Agency (USEPA) adopted
National Emission Standards for Hazardous Air Pollutants (NESHAP) for Asphalt Processing and Asphalt Roofing
Manufacturing.
 
This action promulgates NESHAP for existing and new asphalt processing and asphalt roofing manufacturing
facilities. The USEPA has identified asphalt processing and asphalt roofing manufacturing facilities as major

sources of hazardous air pollutants such as formaldehyde, hexane, hydrogen chloride (HCl), phenol, polycyclic
organic matter, and toluene. The final standards will implement section 112(d) of the Clean Air Act (CAA) by
requiring all major sources to meet HAP emission standards reflecting the application of the maximum achievable
control technology.
 
The total HAP reduction resulting from compliance with the rule is expected to be 86 megagrams per year (Mg/yr).
A variety of HAP are emitted from asphalt processing and asphalt roofing manufacturing source categories. The
following HAP account for the majority (approximately 98 percent, based on the emission factors developed for the
final rule) of the total HAP emissions: formaldehyde, hexane, HCl (at asphalt processing facilities that use
chlorinated catalysts), phenol, and toluene. The remaining two percent of the total HAP emissions is a combination
of several different organic HAP, each contributing less than 0.5 percent to the total HAP emissions.
 
The final rule is effective April 29, 2003.

Board Adopts Proposed Second Notice in Noise Rule Update: Amendments to 35 Ill. Adm. Code 900-903
(R03-08)
 
On April 3, 2003, the Board adopted a proposed second notice opinion and order in Noise Rule Update:
Amendments to 35 Ill. Adm. Code 900-903 (R03-08). The Board will accept comments on the proposal for an
additional 45 days (until May 18, 2003) before sending the rulemaking, pursuant to the Illinois Administrative
Procedure Act (5 ILCS 100/1-1
et seq.
(2002)), to the Joint Committee on Administrative Rules. The Board did not
make any substantive changes to the rules it proposed at first notice (27 Ill. Reg. 1889 and 1909 (February 7,
2003)).
 
The noise rules involved are 35 Ill. Adm. Code Parts 900 and 903. These are general provisions dealing with the
definitions of acoustical terminology, prohibition against noise pollution, and sound measurement procedures. The
proposed changes to Part 900 involve the updating of definitions and sound measurement procedures, which were
adopted in 1973 and have not been amended or changed since. The basis for these changes is the American
National Standards Institute updates from the years 1998-2001.
 
The Board is also proposing to repeal Part 903, which specifies rules and regulations for the control of noise from
motor racing facilities, in response to legislative changes since the Part was adopted.
 
The Board has held two hearings in this rulemaking in Chicago on November 7, 2002 and in Springfield on
November 21, 2002. A third hearing is scheduled for May 15, 2003 in Chicago to address the Department of
Commerce and Community Affairs’ decision not to perform an economic impact study on the Board’s proposal.
 
This rulemaking should be read in conjunction with the companion implementing rules proposed in Proposed New
and Updated Rules for Measurement and Numerical Sound Emissions Standards; Amendments to 35 Ill. Adm. Code
901 and 910, R03-09, (February 20, 2003). See February 3, 2003 Environmental Register at p. 5. Hearings in this
proceeding are scheduled for May 1 (Springfield) and May 15, 2003 (Chicago).

Board Adopts Second Notice Opinion and Order in Petition of Central Illinois Light Company (E. D.
Edwards Generating Station) for a Site Specific Air Regulation: 35 Ill. Adm. Code 214.561 (R02-21)
 
On April 17, 2003, the Board adopted a second notice opinion and order in Petition of Central Illinois Light
Company (E. D. Edwards Generating Station) for a Site Specific Air Regulation: 35 Ill. Adm. Code 214.561 (R02-
21). The Board did not make any substantive changes to the first notice proposal adopted on January 23, 2003 and
published in the
Illinois Register
at 27 Ill. Reg. 2578 (February 14, 2003). Pursuant to the Illinois Administrative
Procedure Act (5 ILCS 100/1-1
et seq.
(2002)), the Joint Committee on Administrative Rules will review and
consider the rules at its May 13, 2003 meeting.
 
The site-specific proposal affects the Central Illinois Light Company (CILCO) E.D. Edwards Generating Station
(facility) located near Peoria in Peoria County. The facility consists of three coal-fired boilers. CILCO previously
received a variance from 35 Ill. Adm. Code 214.141.

(Apr. 15, 1999). The variance is effective through July 31, 2003. Boilers 1 and 3 are subject to a sulfur dioxide
emission limit under a site-specific rule at 35 Ill. Adm. Code 214.561. Boiler 2 is subject to the sulfur dioxide
emissions limit under 35 Ill. Adm. Code 214.141.
 
CILCO seeks to make permanent the relief it was granted in PCB 99-80 by amending 35 Ill. Adm. Code 214.561 to
apply to the operation of Boiler 2. CILCO requested that the Board repeal the text of 35 Ill. Adm. Code 214.561
and replace it verbatim with text from the variance order of April 15, 1999. CILCO asserts that this language has
already been reviewed, approved by the United States Environmental Protection Agency, and incorporated into the
approved Illinois State Implementation Plan pursuant to the Clean Air Act.

This petition replaces CILCO’s earlier-filed petition for adjusted standard seeking the same relief. This petition was

Board Accepts Proposal for Hearing in Amendments to 35 Ill. Adm. Code 602.105, 602.106, 602.108, and
602.115 (R03-21)
 
On April 17, 2003, the Board accepted for hearing a proposal filed on April 7, 2003 by the Illinois Environmental
Protection Agency (IEPA) to amend the Board’s public water supply (PWS) regulations at 35 Ill. Adm. Code 602.
The proposal would allow the IEPA to continue issuing permits to PWS that do not meet the federal radionuclide
standard for drinking water, but only if the PWS is bound by order or agreement to a compliance schedule for
meeting the federal standard. The current exemption in Part 602 that allows such permit issuance “sunsets”
December 8, 2003, which is the compliance deadline of the new federal radionuclide standard (adopted at 65 Fed.
Reg. 76707, December 7, 2000). This proposal would not exempt PWS from the final radionuclide standard, but
would continue the existing State exemption that keeps certain PWS from being placed on “restricted status” (
i.e.
,
an Illinois-only list of PWS banned from receiving construction permits).
 
Section 17.6 of the Illinois Environmental Protection Act (Act) provides that the Illinois radiological quality
standards must be the same as the federal standards adopted by the United States Environmental Protection Agency
(USEPA). 415 ILCS 5/17.6 (2002). That standard, as codified in the Board’s rules, is 5 pico curies per liter (pCi/l)

for combined radium-226 and radium –228 and 15 pCi/l for gross alpha particle activity. 35 Ill. Adm. Code
611.330. Compliance is required effective December 8, 2003.
 
The IEPA anticipates that approximately 50 to 60 PWS may fail to meet the December 8, 2003 deadline and be
subject to the pre-enforcement processes of Section 31 of the Act. However, the IEPA maintains that those PWS
meeting compliance dates of Compliance Commitment Agreements (CCAs) or court orders should be able to avoid
restricted status without having to individually petition the Board for variance relief, expending PWS, Board, and
IEPA resources. Accordingly, the IEPA has requested that the Board adopt final regulations in this rulemaking by
the December 8, 2003 deadline.
 
Additionally, the IEPA’s proposal contains language that would require each person signing a construction permit
application for a PWS to certify that the information in the application is complete and accurate and that the text has
not been altered from the IEPA’s permit application form or template.
 
The Board has scheduled hearings in this rulemaking in Springfield on May 8, 2003 in Room 403, 600 S. Second
Street, and in Chicago on May 15, 2003 in Suite 11-500 in the James R. Thompson Center, 100 W. Randolph Street.

Restricted Status List -- Public Water Supplies
 
 
The Restricted Status List was developed to give additional notification to officials of public water supplies which
are in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois Environmental
Protection Act.
 
The Restricted Status List will include all Public Water Supplies for which the Agency has information indicating a
violation of any of the following requirements: Finished water quality requirements of 35 Ill. Adm. Code, Part 604,
Subparts B and C; maintenance of adequate pressure on all parts of the distribution system under all conditions of
demand; meeting raw water quantity requirements of 35 Ill. Adm. Code 604.502; or maintenance of treatment
facilities capable of providing water "assuredly adequate in quantity" as required by Section 18 of the Illinois
Environmental Protection Act.
 
A public water supply on the Restricted Status List will not be issued permits for water main extensions, except for
certain limited situations, or unless the supply has been granted a variance from the Illinois Pollution Control Board
for the violation, or from permit issuance requirements of Section 39 of the Act.
 
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to
the status of any public water supply should be directed to the Division of Public Water Supplies for final
determination. This list reflects the status as of April 1, 2003.

Critical Review List -- Public Water Supplies
 
 
The Critical Review List was developed to give additional notification to officials of public water supplies which
may be close to being in violation of 35 Ill. Adm. Code, Subtitle F: Public Water Supplies, Chapter I or the Illinois
Environmental Protection Act.
 
A supply will be placed on the Critical Review List when Agency records indicate that it is approaching any of the
violations which would place it on the Restricted Status List.
 
This list is continually being revised as new information becomes available, and therefore, specific inquiries as to
the status of any public water supply should be directed to the Division of Public Water Supplies for final
determination. This list reflects the status as of April 1, 2003.
