Dear Chairman Johnson:
Illinois Public Act 90-489, which became law on January 1,
1998, provides that the Illi-
nois Pollution Control Board (PCB) shall notify the Department of Commerce and Community
Affairs (or DCEO) ofproposed rules not relating to administrative procedures.
Further, the Act
provides that the Board shall request that DCEO conduct economic impact studies ofthe pro-
posed rules
or inform the Board of its explanation fornot producing such studies as allowed un-
der the Act.
As you
are
aware,
DCEO does not
currently have the staiTfresourccs to pcrform cconomic
impact studies on proposed PCB rulemakings.
In addition, financial resources were not appro-
priated in our FY03 budget to either hire staffto perform such analyses or contract with a private
vendor for their completion.
Therefore, please accept this letter as DCEO’s formal response to current
and
future, pro-
posed PCB rulemakings
and
DCEO’s obligation under PA 90-489 to perform economic impact
studies.
