    ORDER OF THE BOARD (R. Flemal):
    This
    matte~ comes before the Board on receipt of an Agency
    Recommendation dated July 18, 1990. The recommendation refers to
    a request from Petitioner, Mazer Chemicals/Division of PPG
    Industries for a 30—day provisional variance from the on-site
    hazardous waste accumulation limitation, as set forth in 35 Iii.
    Adm. Code 722.134, for the period from July 16, 1990 to August
    15, 1990.
    Mazer Chemicals has approximately 75,000 pounds of hazardous
    waste at its Lake County facility. The accumulation start date
    on this waste is April 13, 1990. The waste contains flammable
    solvents (toluene, xylene, and methyl isobutyl ketone) and about
    60 percent water. Mazer Chemicals anticipates that it will
    remove this material from its facility via a licensed special
    waste hauler within 30 to 45 days of the date of its request to
    the Agency, July 11, 1990. Mazer Chemicals maintains that this
    time is necessary to complete the analysis and assessment of the
    BTU value of the waste for use as recovered fuel and schedule
    pickup of the material. Therefore, Mazer Chemicals states that
    this hazardous waste will remain on-site for longer than 90 days
    set forth in 35 Ill. Adm. COde 722.134, and Mazer Chemicals
    requests this provisional variance from that provision.
    Upon receipt of the request, the Agency issued its
    recommendation, concluding that due to unforeseen, temporary and
    uncontrollable circumstances, failure to grant the requested 30-
    day provisional variance would impose an arbitrary or
    unreasonable hardship on Petitioner.
    In light of the Agency Recommendation, the Board hereby
    grants a provisional variance from 35 Ill. Adm. Code 722.134 from
    July 16, 1990 to August 15, 1990.
