    (Permit Appeal - Water)
ORDER OF THE BOARD (by J. Yi):
On September 8, 1997, The City of Lockport (petitioner) and the Illinois
Environmental Protection Agency (Agency) filed with the Board a joint status report and joint
motion for a 30-day extension of the previously granted stay.
Petitioner initiated this permit appeal in response to the Agency’s denial of its request
for a permit to expand its wastewater treatment plant. Since the filing of this matter, the
parties have entered into negotiations in an attempt to resolve the issues raised by the Agency
in its denial letter. The parties’ motion to stay is requested in “light of a potential resolution
of this matter by petitioner and the Agency that may obviate the need for a permit appeal.”
The Board hereby grants the parties’ joint motion for stay thereby staying this matter
through October 20, 1997. The Board orders that, at that time, the parties submit another
status report advising the Board of the status of the parties’ negotiations towards a resolution of
this matter. In the event the parties wish to seek additional stays, such motions should be
directed to the hearing officer, who is hereby authorized to rule on any such motions.
    IT IS SO ORDERED.
    Board Member K.M. Hennessey abstained.
