On October

9,

1990,

the Complainants filed a status report

with the Board.

This

is the third such report filed by the

parties at the Board’s request.

The Complainants indicate that

a

draft Stipulation and Proposal for Settlement was forwarded to

the Respondent

in September.

According to the report,

the

parties are continuing to negotiate a settlement;

however,

the

parties have not been able

to reach an accord as to the penalty

amount.

The Complainants indicate that a hearing may be

necessary.

Therefore,

the Board directs the Hearing Officer to

schedule this matter for hearing no later than November

15,

1990

and to complete all such hearings by January 14,

1991.
