DISSENTING OPINION (by J. Theodore Meyer):
I dissent from the majority opinion because Mobil Oil Corporation (Mobil Oil) has
been seeking relief for 10 years for its ammonia nitrogen discharge limits. While I appreciate
that the discharges have decreased over the years, this variance still allows Mobil Oil to
discharge at three times the standard limit. Mobil Oil has not convinced me that it has
diligently researched alternative reasonably available control technology that could effectively
treat its highly concentrated effluent, other than dilution in the Des Plaines River.
For these reasons, I respectfully dissent.
