    ORDER OF THE BOARD (by T.E. Johnson):
     
    On January 9, 2003, at the parties’ request, the Board extended until March 31, 2003, the
    time period for the Illinois Department of Transportation to appeal a November 26, 2002
    determination of the Illinois Environmental Protection Agency (Agency).

    5/40(a)(1) (2002); 35 Ill. Adm. Code 101.300(b), 105.402, 105.406. 35 Ill. Adm. Code
    101.300(b)(2), 105.404. The Agency approved petitioner’s low priority groundwater monitoring
    plan and proposed budget, with modifications, regarding the Illinois Department of
    Transportation’s UST site at One Langhorn Bond Drive, Sangamon County. Because petitioner
    failed to timely file an appeal, the Board dismisses this case and closes the docket.
     
    IT IS SO ORDERED.
