DISSENTING OPINION (by J. Theodore Meyer):
I dissent from today’s majority opinion because Subpart D of the Board’s
landfill regulations provided sufficient time for landfills to achieve compliance. In
fact, the flooding that occurred in Illinois resulted in an additional six months of time
to achieve compliance. Thus, I believe any hardship experienced by petitioner was
self-imposed and therefore would have denied this variance.
