Opinion & Order of the Board (by Mr. Currie)
Chesterfield seeks a variance to permit connection of
a single-family home t~obe constructed in Highland Park to a
sewer serving the Clavey Road sewage treatment plant of the
North Shore Sanitary District, despite the connection ban
imposed in #70-7, League of Women Voters v. NSSD (March 31,
1972).
In # 71-343, NSSD v. EPA (as revised March 2, 1972),
we have granted the District a blanket variance on the basis
of treatment plant improvements that allows up to 5000 new
connections to be made at Clavey Road and at Waukegan. The
petitioner is free to apply to the District for a~permitunder
that decision. In the absence of showing that such an
application has been denied the present petition is moot and
is therefore dismissed.
