    Opinion of the Board (by Mr. Currie):
    Olin bought low-sulfur coal to comply with episode regulations
    of the Air Pollution Control Board. The sulfur content of
    this coal is slightly above that allowed by new regulations
    we adopted after the purchase, and we granted a variance to
    allow it to be burned in an episode because Olin does not

    supply, which is firm, is interrupted.
    Olin Corp. v. EPA,
    # 70-48 (March 3, 1971). The year our original order ran
    has expired without the need to burn the coal, and Olin has
    renewed its request. We grant it again for the
    same
    reasons, as
    the
    Agency
    recommends.
    Mr. Durnolle dissents.
    ORDER
    The variance granted in #70-48 is hereby extended to February
    17, 1973, to permit Olin to burn an existing stbcW of coal contain-
    ing not
    more than 1.14 suLfur during air pollution episodes,
    on the following conditions:
    1. Olin shall replace the coal when consumed with coal
    meeting the regulation limits; and
    2. Olin shall notify the Agency immediately in the event
    a gas outage occurs during episode conditions.
