Interim Order of the Board
(by Mr.
Currie):
New Jersey Zinc having requested the opportunity to provide
additional evidence and asked that we postpone decision until
after adoption of the regulation from which variance
is sought,
and having executed
a waiver of the requirement
that the Board
decide the case
in
90, days,
the motion to postpone decision and
permit additional evidence is hereby granted and the case
referred to a hearing officer for additional hearing
in accordance
with
the following schedule:
1.
Petitioner shall submit further evidence in the form of
written statements by February
28,
1972;
2.
The Agency may respond within ten days after
such
submission;
3.
A further hearing will be held within ten days after
submission of the Agency’s response, unless the petitioner’s
order of proof is deemed by
the Board to be insufficient
on its face;
and
4.
The Board
hall render
a decision no later than
15
days after receipt of the transcript at the close
of
the formal hearing.
